Legal Authority and Scope

  • Issued under the authority of Section 401 of Presidential Decree No. 1464, as amended.
  • Applies to articles listed in Annexes "A" and "B" classified under Section 104 of the Tariff and Customs Code of 1978, as amended.
  • Staged rates of import duties are prescribed with schedules indicated against each article.
  • Duty rates indicated for 1996 remain effective in subsequent years unless modified.

  • Articles under Annexes "A" and "B" shall pay import duties as prescribed.

  • Articles not listed in the annexes retain their previous rates and classification under Section 104 of the Tariff and Customs Code.

Implementation and Enforcement

  • Upon effectivity, the specified articles entering or withdrawn from warehouses for use in the Philippines are subject to the new duty rates.
  • Ensures the new import duty rates take precedence over inconsistent laws, orders, or regulations which are repealed or modified accordingly.

Effectivity and Publication

  • Executive Order takes effect thirty (30) days after publication.
  • Publication must be in two national newspapers of general circulation within the Philippines.
