Legal basis and authority invoked
- Section 83 of Commonwealth Act No. 141, as amended authorizes reserving specified parcels of public domain for designated public purposes under the conditions stated in the law.
- The President acts pursuant to the recommendation of the Secretary of Agriculture and Natural Resources.
- The reservation is made subject to (a) private rights, (b) future classification and final survey, and (c) conditions and restrictions imposed under the Forest Law and Regulations.
Policy, purpose, and nature of reservation
- The proclamation reserves certain parcels of public domain for settlement and development purposes.
- The reserved lands are for use by the Economic Development Corps (EDCOR).
- EDCOR’s use is under the administration of the Armed Forces of the Philippines.
- The reservation expressly applies subject to private rights, if any there be, preserving existing rights of private parties.
Covered area and land characterization
- The proclamation reserves parcels situated in the barrio of Buriasan, Municipality of Kapatagan, Province of Lanao, Island of Mindanao.
- The proclamation reserves “the following described parcel of land” using a technical boundary description (sketch plan points 1 to 13).
- The reservation excludes portions that are segregated and delimited by the Bureau of Forestry as timberland under its control and administration.
- The proclamation also excludes Block I of approximately 1,000 hectares under Land Classification Project No. 9-C of Parang, Cotabato, certified by the Bureau of Forestry on March 3, 1952.
- The proclamation excludes areas under Pls-263 that have already been given due course by the Bureau of Lands.
Conditions, restrictions, and future steps
- The reserved lands are administered for EDCOR subject to private rights, if any there be.
- The reservation remains subject to future classification and final survey.
- The President’s reservation is further subject to conditions and restrictions imposed under the Forest Law and Regulations.
- The excluded timberland portions are determined through action by the Bureau of Forestry: segregation and delimitation as timberland under its control and administration.
Land description and metes boundaries
- The reservation is defined by a boundary description beginning at point 1 marked “Sapao, barrio Baldon, Parang, Cotabato” on a sketch plan.
- The boundary proceeds:
- From point 1, N. 55A 30a2 W. for about 9,000 meters to point 2.
- Then follows the boundary lines of Cotabato and Lanao in northeasterly and southeasterly directions to the intersection of Cotabato, Lanao, and Bukidnon boundary lines.
- Then follows the boundary line of Cotabato and Bukidnon in a southeasterly direction to a point on the Sayre National Highway.
- Then follows the Sayre National Highway in a southwesterly direction to point 3.
- Then S. 65A W. about 15,900 meters to point 4.
- Then S. 81A 40a2 W. about 14,800 meters to point 5.
- Then S. 86A 30a2 W. about 9,000 meters to point 6.
- Then S. 4A W. about 3,200 meters to point 7.
- Then S. 83A W. about 12,200 meters to point 8.
- Then S. 72A W. about 2,000 meters to point 9.
- Then follows the southwestern boundary of Pls-263 in a northwesterly direction about 2,750 meters to point 10.
- Then due west about 2,750 meters to point 11.
- Then due north about 6,750 meters to point 12.
- Then due east about 5,500 meters to point 13.
- Then N. 9A 30a2 W. about 13,000 meters back to point 1, the point of beginning.
