Requirement for Applicants for Marriage License
- Applicants must receive family planning and responsible parenthood instructions before the issuance of a marriage license.
- Issuance of a certificate of compliance by the Family Planning Office as proof.
- The certificate is provided free of cost.
- In areas without health officers, accredited persons by the Commission on Population may provide instructions.
- If instructions are not given within the required period, the Local Civil Registrar will withhold license issuance for two weeks to allow for compliance.
- After two weeks without instruction given, the license may be issued without the certificate.
Support from National Government Agencies
- National government agencies involved in family planning programs must assist the local Family Planning Offices.
Penalties for Non-Compliance
- Administrative or criminal charges against:
- Family Planning Office members who fail or refuse to give instructions or issue certificates without just cause.
- Local Civil Registrars who issue marriage licenses without the required certificate.
- Individuals who obtain the certificate fraudulently.
Rulemaking Authority
- Commission on Population is empowered to issue rules and regulations to implement this Decree.
Repeal and Modification of Prior Laws
- Any conflicting laws and ordinances are repealed or modified accordingly to conform to this Decree.
Effectivity
- The Decree takes effect immediately upon its issuance.
