Policy and purpose
- The Act authorizes the repatriation of certain former Filipinos who lost Philippine citizenship due to marriage to aliens and due to political or economic necessity (Section 1).
- The Act implements repatriation through oath-taking, civil registry registration, and Bureau of Immigration procedures (Section 2).
Coverage and who may apply
- Section 1 permits Filipino women who lost Philippine citizenship by marriage to aliens to reacquire Philippine citizenship through repatriation.
- Section 1 also permits natural-born Filipinos who lost Philippine citizenship to reacquire Philippine citizenship through repatriation.
- Repatriation applies to minor children of the eligible applicant (Section 1).
- Repatriation eligibility is for cases where loss of citizenship occurred on account of political or economic necessity (Section 1).
- Applicants must not fall within four disqualifications under Section 1:
- Persons opposed to organized government or affiliated with associations or groups that uphold and teach doctrines opposing organized government (Section 1(1)).
- Persons defending or teaching the necessity or propriety of violence, personal assault, or association for the predominance of their ideas (Section 1(2)).
- Persons convicted of crimes involving moral turpitude (Section 1(3)).
- Persons suffering from mental alienation or incurable contagious diseases (Section 1(4)).
Repatriation procedure and required acts
- Repatriation is effected in the manner provided in Section 4 of Commonwealth Act No. 63, as amended (Section 1).
- Repatriation requires taking the necessary oath of allegiance to the Republic of the Philippines (Section 2).
- Repatriation requires registration in the proper civil registry (Section 2).
- Repatriation requires registration in the Bureau of Immigration (Section 2).
- After registration, the Bureau of Immigration shall cancel the pertinent alien certificate of registration (Section 2).
- After cancellation, the Bureau of Immigration shall issue a certificate of identification as Filipino citizen to the repatriated citizen (Section 2).
Legal effect and citizenship documentation
- The Bureau of Immigration cancels the alien certificate of registration upon proper repatriation processing (Section 2).
- The Bureau of Immigration issues a certificate of identification as Filipino citizen to the repatriated citizen (Section 2).
Repeal of inconsistent rules
- Section 3 repeals or amends all laws, decrees, orders, rules and regulations, or parts thereof that are inconsistent with Republic Act No. 8171.
