Authority, attachment, and legal basis
- The MIAA is an agency under the Executive Department, attached to the Department of Transportation and Communications (DOTC).
- The MIAA was created by Executive Order No. 778 (s. 1982), titled “Charter of the Manila International Airport Authority.”
- The expanded airport supervisory concept is tied to the MIAA’s charter and subsequent revisions under Executive Order No. 903 (s. 1983), as amended by Executive Order Nos. 908 (s. 1983) and 298 (s. 1987).
- Executive Order No. 341 authorizes the MIAA to exercise administrative supervision and control over international airports to achieve unified policies and internationally-accepted standards.
Policy and purpose of reorganization
- The order expands the MIAA’s role to achieve unity in national policies and programs for management, operation, maintenance, and development of all international airports in the Philippines.
- The order directs the MIAA to formulate, promote, and implement a comprehensive and integrated program to meet internationally-accepted standards.
- The order is anchored on the MIAA’s expertise in international airport terminal management, operation, maintenance, and development.
Coverage: airports and management scope
- The MIAA is authorized and directed to exercise administrative supervision and control over all international airports in the Philippines under Section 1.
- The supervisory coverage explicitly includes: Loag International Airport, Diosdado Macapagal International Airport (formerly the Clark International Airport), Subic International Airport, Mactan-Cebu International Airport, Francisco Bangoy International Airport in Davao, General Santos International Airport, Zamboanga International Airport, and such other international airports as may be established.
- The MIAA’s supervision covers matters involving management, operation, maintenance, or development of international airports under Section 1.
- The General Manager is the implementing focal point for actions described in Section 1.
Administrative supervision and control powers
- The MIAA, through its General Manager, may act directly on any matter involving management, operation, maintenance, or development of international airports.
- The MIAA, through its General Manager, may direct officials of international airports to perform their duties or to retrain the commission of acts.
- The MIAA may review, approve, reverse, or modify acts and decisions of the governing board, officials, or units of the international airports.
- The MIAA may determine priorities in the execution of plans and programs.
- The MIAA may prescribe standards, guidelines, plans, and programs for the international airports.
- All such actions are framed to ensure international airports are managed and developed according to internationally-accepted standards.
Reporting to the President
- The MIAA, through its General Manager, must submit to the President a report through the Secretary of DOTC under Section 2.
- The report must be integrated and comprehensive.
- The report must be submitted on an annual basis.
- The report generally covers the MIAA’s expanded functions, activities, and operations as provided in Executive Order No. 341.
Rules and regulations; consultation
- The MIAA is authorized to issue rules and regulations for effective implementation of Executive Order No. 341 under Section 3.
- Rule issuance is subject to consultation with the DOTC Secretary.
- The rules and regulations must support the effective implementation of the order’s provisions.
Assistance and cooperation mandate
- The MIAA and the MIAA General Manager may call upon any agency or office of the Government for necessary or appropriate assistance in performing functions under Section 4.
- Heads of departments, agency bureaus, and offices—including government-owned or controlled corporations—are enjoined to render full assistance and cooperation to the MIAA and the General Manager.
- Government units must provide information and data as required to carry out functions under Executive Order No. 341.
Repeals and effectivity rule
- Section 5 provides that all executive issuances, rules and regulations, or parts thereof inconsistent with Executive Order No. 341 are repealed, amended, or modified accordingly.
- Section 6 states that Executive Order No. 341 takes effect immediately.
