Composition of the Commission
- The Commission consists of a Chairman and two Commissioners.
- Commissioners are appointed by the President for a single seven-year term without reappointment.
- Appointments to vacancies cover only the unexpired term of the predecessor.
Powers and Functions of the Commission
- Administer and enforce merit system provisions for all civil service levels.
- Prescribe and enforce rules for implementing this Executive Order, the Civil Service Law, and related laws.
- Set policies, standards, and programs to promote efficient government personnel administration.
- Formulate policies on position classification, compensation, and pay scale standards.
- Issue binding opinions and rulings on personnel and civil service matters.
- Appoint, discipline, and supervise its officers and employees.
- Control and coordinate Civil Service examinations, including exemptions from inspection of examination materials.
- Prescribe all required forms for exams, appointments, and reports.
- Declare civil service positions as confidential, technical, or policy-determining.
- Develop programs to retain qualified public service workforce.
- Hear and decide administrative cases directly or on appeal; decisions are final, enforceable, and appealable only by certiorari to the Supreme Court within 30 days.
- Issue subpoenas and conduct investigations related to civil service functions.
- Advise the President on personnel management and submit annual reports.
- Take actions on appointments and personnel matters, including extension beyond retirement age.
- Delegate functions to various ministries and agencies.
- Inspect and audit personnel programs and apply sanctions as necessary.
- Administer retirement programs and maintain personnel records.
- Perform all other functions of a central personnel agency as mandated by law.
Duties and Responsibilities of the Chairman
- Direct operations and establish procedures for effective Commission function.
- Transmit rules, regulations, and reports to the President.
- Issue appointments and enforce disciplinary measures.
- Delegate authority within the Commission.
- Approve and submit the Commission's budget.
- Perform other legally provided functions.
Duties and Responsibilities of Commissioners
- Cooperate with the Chairman in rule-making and adjudicative functions.
- Perform delegated functions.
- The senior member acts as Chairman during the Chairman’s absence.
Organizational Structure: Offices and Boards
- The Commission is composed of multiple offices, each headed by a Director and assisted by Assistant Directors.
- Offices include Executive Director, Legal Affairs, Planning and Management, Central Administrative, Central Personnel Records, Position Classification and Compensation, Recruitment and Examination, Career Systems and Standards, Human Resource Development, Personnel Inspection and Audit, Personnel Relations, Corporate Affairs, Retirement Administration, and Regional/Field Offices.
- The Merit Systems Protection Board (Chairman and two members) hears appeals on administrative cases and personnel actions; its decisions are generally final except certain dismissal appeals.
- Regional Offices enforce laws, provide technical assistance, and perform delegated duties.
Staffing and Transition
- Existing officers and employees continue duties in hold-over capacity unless separated under specified provisions.
- Separated personnel receive retirement benefits or separation pay.
- Legal restrictions prevent injunctions against separations/replacements under this Order.
- The Office of Compensation and Position Classification and Special Committee on Scholarships are transferred to the Commission with their assets and personnel.
- Personnel without positions in the new structure shall be separated with benefits.
Relationship with Development Academy of the Philippines
- The Academy is attached to the Commission focusing on training and professionalization of government executives.
- It is prohibited from private sector consultancy.
- Reorganization laws or issuances for the Academy will be submitted within six months.
Chairmanship and Board Memberships
- The Chairman serves on boards affecting government personnel matters such as GSIS and Foreign Service Boards.
Funding
- Initial funding derives from the Commission's existing budget, augmented by the National Treasury if needed.
- Subsequent budgets to be included in the annual General Appropriations Act.
Legal Provisions
- Separability Clause ensures invalid provisions do not affect the remainder of the Order.
- Repealing Clause rescinds inconsistent laws, orders, issuances, and regulations.
- The Executive Order takes effect immediately upon approval.
