Mtrcb Memorandum Circular No. 93-028

A

Exemption renewal timing and reapplication

  • Television programs enjoying the privilege of Exemption from Review must apply for an extension up to the end of the month of December of the year the exemption was granted.
  • With the start of a new calendar year, the producer/blocktimer/co-producer must formally re-apply for the exemption privilege.
  • Renewal requests must follow the formal re-application requirement for each new calendar year.

Board action: automatic grant or review

  • The MTRCB may automatically grant the re-applied exemption privilege.
  • The MTRCB may wish to review anew the three latest episodes of the program.
  • The Board retains control over whether it grants the renewal automatically or conducts episode review.

No vested right; continued regulatory control

  • The grant of the privilege of Exemption from Review does not give any program a vested right to future exemptions.
  • The MTRCB reserves the right to pass upon the fitness of any exempted program at any time.
  • The exemption remains subject to ongoing Board evaluation and regulatory standards.

Automatic cancellation for rule violations

  • Any violation of MTRCB rules and regulations automatically cancels the exemption.
  • Cancellation applies as a direct consequence of the violation, without requiring a separate discretionary act stated in the circular.
  • The Board’s authority to evaluate fitness at any time reinforces that exemption privileges remain conditional.
