Executive Order No. 51 reinforces the Diversity and Inclusion Program in the Philippines, reconstitutes the Inter-Agency Committee on Diversity and Inclusion, and creates a Special Committee on LGBTQIA+ Affairs to address discrimination and promote the rights of the LGBTQIA+ community.

Reconstitution of the Diversity and Inclusion Committee

  • The Inter-Agency Committee on Diversity and Inclusion is reconstituted as the Diversity and Inclusion Committee under the Department of Social Welfare and Development (DSWD).
  • The Committee's composition includes key Cabinet Secretaries and Chairpersons, including DSWD, Department of Migrant Workers, Department of Labor and Employment, Department of the Interior and Local Government, Department of Education, Department of Justice, Department of Health, Commission on Higher Education, and the Special Committee on LGBTQIA+ Affairs.
  • The Committee can create sub-committees and working groups to assist in its functions.
  • Members may designate alternates with appropriate ranks authorized to decide on their behalf.
  • The Committee convenes at least quarterly or as needed.

Establishment of the Secretariat

  • The Secretariat is established within the DSWD to provide administrative and technical support to the Committee.
  • The DSWD is responsible for determining staffing patterns and qualifications and must submit proposals to the Department of Budget and Management (DBM).
  • Pending approval, member agencies are directed to detail personnel to support immediate implementation.

Development and Submission of the Diversity and Inclusion Program (DIP)

  • Member agencies must submit their policy frameworks on diversity and inclusion to the Committee via the Secretariat.
  • The Committee, in consultation with the Commission on Human Rights, Civil Service Commission, and stakeholders, consolidates these frameworks to develop the DIP.
  • The DIP serves as the National Government's blueprint for anti-discrimination programs harmful to persons based on various personal characteristics.
  • The DIP must be submitted to the Office of the President within six months from the order's effectivity.

Creation of the Special Committee on LGBTQIA+ Affairs

  • A Special Committee with a Chairperson (Undersecretary rank) and three members (Assistant Secretary rank) appointed by the President, representing reputable LGBTQIA+ organizations, is created under the Diversity and Inclusion Committee.
  • Additional ex-officio members from DMW, DOLE, and DepEd (Assistant Secretary rank or equivalent) are included.
  • The Special Committee meets at least quarterly and is supported administratively by the Secretariat.

Functions of the Special Committee on LGBTQIA+ Affairs

  • Ensuring inclusion of LGBTQIA+ equality, non-discrimination, and well-being policies in the DIP.
  • Assisting in reviewing and recommending measures to strengthen programs addressing LGBTQIA+ concerns.
  • Coordinating with agencies to secure reliable data on the LGBTQIA+ community for evidence-based policymaking.
  • Facilitating continuous dialogue between government and LGBTQIA+ community.
  • Facilitating campaigns for LGBTQIA+ rights protection upon Committee approval.
  • Leading identified programs and advocating for LGBTQIA+ rights in healthcare, education, employment, legal recognition, and social acceptance.
  • Performing other tasks directed by the Committee, President, or Executive Secretary.

Whole-of-Government Approach

  • All national government agencies, including government-owned or -controlled corporations, must support implementation.
  • Local government units are encouraged to back the Committee and Special Committee initiatives.

Funding

  • Initial funding is charged to the appropriations of concerned agencies.
  • Further funding needs are to be included in agencies' budget proposals following standard budget processes.

Implementing Guidelines

  • The Committee must issue implementing guidelines within 60 days from effectivity, covering the DIP update, Special Committee constitution, and Secretariat creation.

Separability Clause

  • If any provisions are declared invalid or unconstitutional, the remaining provisions remain effective.

Repeal and Amendments

  • Executive Order No. 100 (2019) is amended.
  • All inconsistent issuances, orders, or regulations are repealed or modified.

Effectivity

  • The Order takes effect immediately upon publication in the Official Gazette or any newspaper of general circulation.
