Community Fireworks Display Requirements

  • Use of firecrackers is limited to community fireworks displays to minimize injuries and casualties.

Be supervised by a trained, PNP-licensed individual. c. Be authorized by the local municipality or city through a permit detailing date, time, and location, consistent with national standards.

Use of Other Pyrotechnic Devices

  • Pyrotechnic devices other than firecrackers may be used outside community fireworks displays but must comply with existing laws and regulations.

Prohibited Firecrackers and Pyrotechnic Devices

  • Within 30 days from the Executive Order’s effectivity, the PNP Director-General must define prohibited devices.
  • A specific list of these devices must be made available to the public.
  • Prohibited fireworks cannot be manufactured, sold, distributed, or used, even in community fireworks displays.

Implementing Rules and Regulations

  • The PNP, with the DOH, DILG, DENR, and BFP, is tasked with formulating implementing rules after public consultations.
  • These rules will include guidelines on permissible areas for community fireworks displays.
  • The implementing rules become part of the relevant provisions under Republic Act No. 7183.

Enforcement and Administration

  • Primary enforcement responsibility lies with the PNP coordinated with other agencies and local government units.
  • Enforcement activities include inspections, confiscations, and destruction of prohibited devices pursuant to law.

Support from Other Government Agencies

  • All government departments and agencies, including government-owned or controlled corporations, must support and assist in implementing this Order.

Public Information Campaign

  • The DOH, Department of Education, BFP, PNP, DENR, and local governments must conduct information campaigns on the dangers of using fireworks.

Reporting Requirements

  • The PNP, DILG, and DOH must submit consolidated reports every six months to the Office of the President.
  • Reports must include statistics on firecracker-related victims by municipality or city.

Funding

  • Implementation funds shall come from the appropriations of all involved government departments, agencies, and local government units.

Separability Clause

  • If any provision is declared invalid or unconstitutional, the other provisions shall remain effective and enforceable.

Effectivity

  • The Executive Order takes effect immediately upon promulgation.
