Scope and Coverage

  • Applies to anahaw poles and leaves within forestlands, alienable and disposable public lands, and titled private lands.
  • Cutting, gathering, and use of anahaw in protected areas under the NIPAS Act are prohibited.
  • No permit is required for planted anahaw palms within titled private lands.
  • Maximum area granted for utilization: 5,000 hectares for individuals, 30,000 hectares for cooperatives.

Qualified Applicants

  • Filipino citizens of legal age.
  • Cooperatives registered with the Cooperative Development Authority (CDA).
  • Priority given to local residents within forestlands and public lands; only landowners may apply in titled private lands.
  • Community-Based Forest Management Agreement (CBFMA) holders may cut anahaw within their area if covered by a Resource Use Permit (RUP).

Application Requirements

  • Letter of application.
  • Certification of residency from Barangay Chairman for individuals; Certificate of registration and good standing from CDA and Mayor’s certification for cooperatives.
  • Map of the area applied for.
  • Authenticated copy of land title.

Initial Environmental Examination (IEE)

  • Submission of IEE to the DENR required as basis for Environmental Compliance Certificate (ECC).
  • ECC not required if the titled property area is 5 hectares or less.

Forest Products Inventory

  • 100% inventory intensity for titled private lands; minimum of 5% for forestlands.
  • Inventory conducted by a Registered Forester.
  • Includes mapping, diameter and height measurement, regeneration count, and leaf count.
  • Numbering, photographing, and documentation of palms.
  • Inventory report must be sworn and submitted for validation.

Annual Allowable Cut (AAC)

  • Poles: Diameter breast height (dbh) of 11 centimeters and above may be cut in titled private lands.
  • AAC in forestlands formula: AAC = (Number of palms per hectare x Area in hectares)/15 years.
  • Leaves: Maximum of 2 leaves per stem per month allowed; annual allowable cut equals total density multiplied by 24 leaves.

Non-Timber Forest Product Permit (NTFPP)

  • Issued for cutting, gathering, and use of anahaw poles and leaves.

Conditions of the Permit

  • Permit holders must plant two (2) anahaw palms for every palm cut.
  • Failure to comply may result in suspension or non-renewal of permit.

Issuing Authority

  • Regional Executive Directors (RED) of DENR are responsible for issuing permits.

Tenure

  • Permits are valid for one (1) year and renewable annually.

Transport Requirements

  • Transport must be accompanied by:
    • Certificate of Non-Timber Forest Products Origin (CNFPO).
    • Tally sheets.
    • Delivery receipts or auxiliary invoices.
  • For planted anahaw within titled private lands, a certificate of verification from DENR CENRO official suffices.

Penal Provisions

  • Unauthorized cutting, gathering, or transport without permits or documents is illegal.
  • Illegal anahaw products subject to confiscation and legal disposal.
  • Criminal charges may be filed against violators.
  • DENR officials issuing defective documents face disciplinary actions per Civil Service laws.

Repealing Clause

  • All inconsistent orders, circulars, or instructions are repealed or modified accordingly.

Effectivity

  • Order effective immediately upon acknowledgment by the U.P. Law Center and after 15 days from publication in two newspapers of general circulation.
