Minimum Distance Requirements

  • Poultry farms must be located at least one (1) kilometer from the center of national highways.
  • Commercial swine and cattle feedlot farms must be at least three (3) kilometers from the center of national highways.
  • Farms must maintain a minimum distance of one (1) kilometer from each other.
  • Farms must also be at least one (1) kilometer away from the boundaries of built-up areas as defined by the respective Local Government Units (LGUs).
  • Exceptions to distance requirements may be granted if advanced waste management technologies are applied.

Measurement Basis for Compliance

  • Distances are measured from the waste management facility of the farm.
  • This applies to distance measurements between farms, from national highways, and from built-up area boundaries.

Waste Management Facility Standards

  • The waste management facility must comply with the Environment Clearance Certificate (ECC) requirements issued by the Department of Environment and Natural Resources (DENR).

Inspection and Enforcement

  • Farms are subject to inspection by the Department of Agriculture - Bureau of Animal Industry (DA-BAI) through its Regional Field Units (RFUs).
  • Inspections are conducted in coordination with Local Government Units and relevant special bodies.
  • The biosecurity protocols of the inspected farm must be observed during inspections.

Penalties for Violations

  • Violators of this order will be penalized under the existing rules of Republic Act 8485, also known as the Animal Welfare Act of 1998.

Non-Retroactivity Clause

  • This order does not apply to poultry and swine farms established before its approval date.

Effectivity

  • The order takes effect fifteen (15) days after publication in two (2) newspapers of general circulation.
