Registration of Master Deed and Declaration of Restrictions
- Section 4 of the Condominium Act (R.A. No. 4726) mandates that the condominium project is constituted by the recording of the master deed in the Register of Deeds and annotation on the corresponding certificate of title.
- Section 9 requires the registration of the declaration of restrictions before the conveyance of any condominium unit.
- Therefore, the certificate of registration and license to sell from HLURB shall not be required for the recording of the master deed and the declaration of restrictions in the Register of Deeds.
Submission Requirements Before Conveyance
- Prior to the registration of the conveyance of any condominium unit, the submission of the HLURB-certified certificate of registration and license to sell is mandatory.
- This is in accordance with NLTDRA (LRC) Circular No. 73, dated 7 March 1986.
Directive to Registries
- Registries of deeds are directed to strictly comply with these guidelines to avoid conflicting requirements.
- Certification by HLURB must be secured before conveyance registration but is not a prerequisite for master deed and declaration registration.
