Allocation and Use of the Reforestation Fund
- Funds collected shall be used exclusively for reforestation and afforestation projects.
- Target areas include watersheds, denuded areas, cogon and open lands within forest reserves, communal forests, national parks, timber lands, sand dunes, and other public forest lands.
- The purposes include establishing forest cover, promoting economic tree growth (timber, tannin, oils, gums, medicinal plants), watershed protection, prevention of erosion and floods.
- Expenses covered also include planning, cost estimation, reconnaissance surveys, and other necessary activities.
- Proceeds from sale of barks, medicinal plants, and other plantation products also contribute to the fund.
- The fund is managed by the Director of Forestry with approval from the Secretary of Agriculture and Commerce.
- Provincial and city treasurers and their deputies act as agents for collection.
Rule-Making Authority
- The Director of Forestry, with the Secretary’s approval, is empowered to promulgate necessary rules and regulations to implement the Act’s objectives.
Reporting Requirements
- The Director of Forestry must submit an annual report to the President through the Secretary of Agriculture and Commerce.
- Report includes reforested/afforested locations and areas, costs, income from the Act including sales, and any other relevant data.
Penalties for Non-Payment
- Entities failing to pay the required charges upon demand incur a fine of at least five hundred pesos plus a surcharge of 25% of the amount due.
- Non-payment within 60 days may lead to license cancellation and forfeiture of bond deposit.
Repeal of Contradictory Laws
- All laws or parts of laws inconsistent with this Act are repealed.
Effectivity
- The Act takes effect immediately upon approval.
