Reconstitution of the Board of Governors
- The Board of Governors of the NCA is reconstituted to include the Minister of Transportation and Communications as an ex officio member.
- This inclusion replaces the prior member appointed by the President from the private sector.
- The Board’s composition consists of:
- Minister of Energy (ex officio Chairman)
- Minister of Industry
- Minister of Natural Resources
- Minister of the Budget
- Minister of Transportation and Communications (ex officio member)
Expanded Powers and Functions of the National Coal Authority
- The NCA, in addition to powers under Presidential Decree No. 1722, is authorized to:
- Succeed in its corporate name with power of succession.
- Sue and be sued in its corporate name.
- Adopt, alter, and use a corporate seal which shall be of judicial notice.
- Adopt, amend, and repeal its by-laws.
- Engage in any activity and exercise all powers conferred by law on private corporations.
Immediate Effectivity
- The Executive Order takes effect immediately upon issuance.
Legal Authority and Purpose
- The changes aim to better reflect the organizational structure and functions of the NCA.
- It aligns membership of the Board with relevant government ministries for effective policy coordination.
- It clarifies and broadens NCA’s corporate powers to enable more efficient operation in support of national energy self-sufficiency goals.
