Executive Order No. 112 re-directs the functions of the Department of National Defense in the Philippines to enhance its effectiveness in addressing defense concerns, promoting soldier welfare, and coordinating disaster response efforts.

Law Summary

Roles and Responsibilities

  • Serve as lead agency in formulating national defense-security policies, plans, and programs.
  • Monitor and evaluate implementation of defense and security policies and programs.
  • Administer National Disaster Coordinating Council special funds to assist LGUs and communities affected by calamities.
  • Innovate new defense and security strategies aligned with the national defense plan.
  • Enable NGAs, LGUs, GOCCs, NGOs, POs, and civil society in civil defense and socio-economic programs with military assistance.
  • Advocate for social and economic development concerns including resource and environmental protection, emergency preparedness, and soldiers/veterans welfare.
  • Implement international defense and security commitments from treaties and agreements.

Functional Focus of the DND

  • Formulate, develop, and promote defense and security policies in coordination with the National Security Council (NSC).
  • Direct, plan and supervise the national defense program.
  • Conduct research and policy studies to ensure effective implementation of defense plans and related projects.
  • Exercise supervision and control over the AFP, Government Arsenal, Office of Civil Defense, Philippine Veterans Affairs Office, and National Defense College.
  • Supervise standards, accreditation, and technical assistance for emergency management organizations.
  • Advocate and disseminate information on defense-security issues.
  • Provide funding and resources to civil defense partners.
  • Coordinate with the Department of Foreign Affairs to maintain defense and military international cooperation.
  • Perform other functions as provided by law.

Rationalization and Organizational Adjustment Plan (ROAP)

  • To prepare a plan focusing on organizational efficiency and effectiveness.
  • Framework includes:
    • Clustering bureaus and offices for accountability.
    • Establishing a clear reporting system with defined authority lines.
    • Realignment of offices based on functions: operations; policy and strategic planning; administration and finance.
    • Rationalization of staffing including plans for casual position occupants.
  • ROAP must be submitted to the Department of Budget and Management (DBM) for approval before implementation.
  • DBM is authorized to create or upgrade key positions if necessary.

Redeployment of Personnel

  • Personnel will be redeployed according to ROAP and civil service laws.
  • Redeployment shall not reduce rank or compensation of personnel affected.

Funding

  • Implementation funding to come from existing DND funds.
  • Total cost must not exceed authorized appropriations for Personal Services.
  • Outlay for Personal Services covered by the existing Organizational Adjustment Fund of RA 8745.

Repealing Clause

  • Any executive orders or issuances inconsistent with this order are rescinded or modified accordingly.

Separability Clause

  • If any provision is declared invalid, the remaining provisions shall remain valid and binding.

Effectivity

  • The Executive Order takes effect immediately upon issuance.
