Prohibition and Conditions for Mining in National Park, Wildlife Sanctuary, and Game Preserve
- Proclamation No. 1636 covers certain protected areas outside the Marikina Watershed.
- Mining/quarrying is prohibited for land titles issued after the proclamation; permits/contracts are revoked.
- Existing valid land titles and permits/contracts before Proclamation 1636 may continue under strict conditions:
- Full compliance with Environmental Compliance Certificate (ECC) and laws.
- Submission and approval of Environmental Protection and Enhancement Program (EPEP) including rehabilitation and decommissioning plans.
- Establishment of Contingent Liability and Rehabilitation Fund (CLRF).
- Application of best practices in environmental management.
- Completion of environmental rehabilitation to address siltation and erosion before resuming operations.
- Clearance from local government units including tax payments.
- Phased cessation of operations within 3-5 years, subject to review by Protected Area Management Board (PAMB).
Mining/Quarrying in Lungsod Silangan Townsite Reservation
- Mining/quarrying allowed only upon securing clearances from RIZLAQUE Commission and other agencies.
- Full compliance required with mining and environmental laws and regulations.
Conditions for Mining Operations in San Isidro-Lukutan Areas
- Mining cannot resume unless the following are fulfilled:
- Full soil profiling and validation by Mines and Geosciences Bureau (MGB).
- Submission and approval of an integrated mining/quarrying plan addressing overburden handling and slope stabilization.
- Establishment of proper waste disposal, containment, drainage, and clean-up systems.
- Compliance with ECC conditionalities as well as EPEP and CLRF requirements.
Regulation of Crushing Operations
- Only crushing plants with appropriate permits including ECC and EPEP, located outside Marikina Watershed and within allowed zoning, may operate.
Rules on Renewal and New Mining/Quarrying Applications
- No acceptance of new applications within Marikina Watershed and Proclamation No. 1636 areas.
- Renewals only to allow phased out completion under the conditions of Item 2.
- Only advanced-stage pending applications with inchoate rights may proceed, subject to phasing out.
Operationalization of Contingent Liability and Rehabilitation Fund (CLRF)
- Establish a Rehabilitation Cash Fund (RCF) of P5 million or 10% of EPEP cost.
- Set up a Monitoring Trust Fund (MTF) of not less than P50,000 for ongoing monitoring.
- Creation of Multipartite Monitoring Team (MMT) comprising MGB, DENR, permittees, communities, and NGOs for oversight.
Memorandum of Agreement for Monitoring and Enforcement
- An MOA between DENR, Rizal Provincial Government, and Philippine National Police (PNP) Rizal Office.
- Ensures strict enforcement of this order and related environmental and mining laws.
Repealing Clause
- Repeals or modifies inconsistent memorandum orders, circulars, or instructions.
Effectivity Clause
- The Order takes effect immediately upon issuance on March 3, 1999.
