Composition of the Quezon City Heritage Council
- Honorary Chairpersons: City Mayor and City Vice Mayor.
- Chairman: Head of City Planning and Development Office (CPDO).
- Vice Chairman: Chairperson of the Cultural and Tourism Affairs Committee of the City Council.
- Secretariat: Cultural and Tourism Affairs Office (CTAO).
- Members include heads or representatives from city administration, planning, engineering, parks, budget office, Bureau of Customs (BOC), National Historical Commission of the Philippines (NHCP), and academicians specializing in relevant fields such as history, art, archaeology, anthropology, and architecture.
Powers and Responsibilities
- Define "Quezon City Treasures" and establish criteria for designation.
- Investigate, research, and collect data on historical events, places, objects, and personalities related to Quezon City's heritage.
- Formulate plans and strategies for development, protection, and promotion of City Treasures.
- Declare historical, cultural, and heritage sites, structures, events, objects, and personalities as City Treasures after due investigation.
- Conduct inspections of City Treasures to ensure protection and integrity.
- Inspect public or private collections with owners' written consent.
- Issue Cease and Desist Orders to halt activities endangering cultural properties, with due notice and hearing.
- Order repairs or maintenance for neglected privately owned heritage sites; if orders are ignored within 40 days, the city may undertake repairs at the owner's expense.
- Deputize law enforcement and other city departments to enforce the ordinance.
- Recommend acquisition or partnership with private owners of City Treasures.
- Maintain and update the registry of heritage properties and submit reports to relevant city and national authorities.
Meetings and Compensation
- The Council will conduct regular meetings as scheduled or as required by the city government.
- Council members, including the Chairman, serve without monetary compensation.
Incentives and Privileges for Cultural Property Owners
- Donations to the Committee or City exempt from donor's tax and deductible for income tax purposes.
- Tax credits granted to owners of privately-owned cultural structures.
- Priority funding for protection, conservation, and restoration of City Treasures.
- Incentives and support from national agencies for conservation efforts.
- Placement of a "Quezon City Treasure Marker" on recognized immovable cultural properties.
Appropriations
- Allocates Five Million Pesos (Php5,000,000.00) from the City Treasury for the establishment and operations of the Heritage Council.
Prohibited Acts
- Intentional destruction, demolition, or damaging of cultural and City Treasures.
- Unauthorized modification, alteration, or development on declared heritage sites or buffer zones (5 meters perimeter).
- Importation, sale, distribution, acquisition, or export of stolen or unlawfully taken cultural treasures.
Penalties
- First Offense: Warning and fine of Php 3,000.
- Second Offense: Fine of Php 4,000 and imprisonment of not less than two (2) years.
- Third Offense: Fine of Php 5,000 and imprisonment of up to six (6) years.
- Penalties are in addition to applicable national laws.
Implementation and Rulemaking
- The City Mayor must convene the Council within one month after ordinance approval to formulate implementing rules and regulations.
- The Council must submit rules and recommendations to the Mayor within one month; failure of Mayor to act within 15 days deems recommendations approved.
Legal Provisions
- Separability Clause: Invalidity of any provision does not affect the rest of the ordinance.
- Repealing Clause: Inconsistent ordinances, executive orders, or rules are repealed or modified accordingly.
- Effectivity: The ordinance takes effect immediately upon approval.
