Conditions for Surrender and Immunity

  • Persons possessing firearms, ammunition, or explosives without proper licenses may surrender them to authorities within six months of the order without facing criminal charges.
  • Immunity does not apply if the person carries the unlicensed items outside their residence without a written transport authority or commits any offense using the items during the six-month period.

Exclusion of Persons Already Charged or Convicted

  • Individuals already arrested, charged, or convicted for illegal possession are disqualified from availing of the surrender benefits provided by this order.

Application for License Post-Surrender

  • Persons surrendering firearms may apply for a license to possess the same firearm after surrender, provided they meet qualifications under existing laws and regulations.

Disposal of Non-Licenseable Firearms

  • Firearms that cannot be licensed to the surrendering person may be sold to qualified buyers (individuals, firms, corporations).
  • Sale proceeds shall be credited to the person who surrendered the firearm.

Rule-Making Authority

  • The Chief of the Philippine Constabulary is empowered to issue rules and regulations necessary for implementing the provisions of this Executive Order.

Effectivity

  • The Executive Order took effect immediately upon issuance on December 24, 1986.
