Upgrade and Functions of the Law Enforcement Service
- Existing Law Enforcement Division upgraded to the Law Enforcement Service.
- Retains the same powers and functions as the division previously exercised.
- Primarily responsible for enforcing traffic laws, rules, and regulations.
Powers and Functions of the Traffic Adjudication Service
- Authority to hear and decide all cases involving traffic law violations and impose fines or penalties.
- Excludes cases involving property damage, physical injuries, or crimes under the Revised Penal Code, which fall under regular courts.
- Power to order vehicle impoundment, plate confiscation, and arrest of traffic violators.
- Ability to issue subpoenas, subpoena duces tecum, summon witnesses, and administer oaths.
- Empowered to promulgate procedural rules that differ from court rules to ensure efficient fact-finding and due process.
- May carry out other duties necessary or incidental to its functions under the law.
Cooperation with Other Law Enforcement Agencies
- Both the Law Enforcement Service and Traffic Adjudication Service can request assistance from the Philippine Constabulary, Highway Patrol Group, Integrated National Police, and other government agencies for enforcement activities.
Funding and Implementation
- Financial requirements to implement this order are to be sourced from existing Department funds or future appropriations.
Modifications and Effectivity
- This Executive Order modifies Executive Order No. 125 and its amendments.
- The order takes effect immediately upon issuance.
