Identification of Site for Philippine Trade Center
- The Department of Trade and Industry (DTI) identified a reclaimed land parcel occupied by the Center for International Trade Expositions and Missions (CITEM) as the ideal location.
- This land is conveyed under Executive Order No. 989 and is contiguous to major roads in Pasay City.
Private Ownership and Government Guarantees Concerning Land Title
- The land title was held by the Philippine National Construction Corporation (PNCC) under contracts dating back to 1973.
- The Department of Public Works and Highways (DPWH) guaranteed PNCC's rights to the land.
- The land parcel is approximately 50,642 square meters including the portion covered by Transfer Certificate of Title (TCT) No. 34996.
Assignment of Rights to the Department of Finance and Bureau of Treasury
- PNCC assigned all rights, title, and interest in the land to the Department of Finance (DOF) and Asset Privatization Trust (APT) in August 1995.
- Subsequently, DOF and APT assigned these rights to the Bureau of Treasury.
- The Committee on Privatization approved these transactions.
Land Available for Long-Term Lease to Accredited Export Organization
- The 50,642 square meters land is made available for long-term lease to the accredited organization representing exporters' interests.
Authority Given to Secretary of Trade and Industry (DTI)
- The Secretary of DTI is authorized to negotiate and execute a three-year lease contract with PHILEXPORT.
- This lease is assignable to the next accredited export organization after the initial term.
Lease Terms and Purpose
- Lease rate is fixed at PHP 1,000 per year to support export promotion.
- The land will house the Philippine Trade Center and related complexes such as the World Trade Center aimed at international exhibitions.
Rights to Sublease and Use of Revenues
- The accredited organization may sublease to other entities for setting up trade center facilities.
- All revenues generated must be used exclusively for export development and promotion, as per Republic Act No. 7844.
Oversight and Reporting Requirements
- The accredited organization must regularly report to the Export Development Council (EDC) regarding funds usage.
- The EDC must formulate guidelines within 90 days to ensure proper use of funds.
Modification of CITEM Capital Structure
- The capital structure of CITEM is modified to comply with this Executive Order.
- The Board of Governors of CITEM is responsible for implementing and approving necessary changes.
Repeal and Amendment of Inconsistent Provisions
- Any conflicting provisions in previous executive orders, especially EO No. 989, relative to the specified land are repealed or amended accordingly.
Separability Clause
- If any provision of this Executive Order is held unconstitutional, the remaining provisions shall continue to be valid and enforceable.
Effectivity
- The Executive Order took effect immediately upon signing on December 13, 1995.
