Creation of Land Transport Service Units

The existing Law Enforcement Division is upgraded to a full-fledged service unit known as the Law Enforcement Service.
This service retains all powers and functions previously exercised by the division.

Hear and decide cases involving violations of traffic laws, imposing fines and penalties.
Jurisdiction excludes cases involving physical injuries, property damage, or criminal offenses under the Revised Penal Code and other penal laws, which remain with regular courts.
Authority to order impounding of motor vehicles, confiscation of plates, and arrest of violators.
Power to issue subpoenas (including subpoena duces tecum), summon witnesses, and administer oaths.
Promulgate rules and regulations for proceedings, adopting flexible procedural rules prioritizing fact-finding and due process over strict technical legal rules.
Perform other functions as provided by law or necessary to its defined powers.

Both the Law Enforcement Service and the Traffic Adjudication Service may seek assistance from the Philippine Constabulary, especially the Highway Patrol Group, the Integrated National Police, and other government agencies.

Necessary funds to implement the Executive Order are sourced from existing departmental funds or future appropriations.

This Executive Order modifies and supersedes Executive Order No. 125 and its amendments, specifically Executive Order No. 125-A.

The establishment of these service units aims to enhance the enforcement of traffic laws through specialized and quasi-judicial functions within the Department of Transportation and Communications.
The arrangement reflects a structured approach to traffic law enforcement and adjudication, separating enforcement duties from adjudicatory functions for efficiency and clarity in operations.
