Authority to Issue Implementing Rules and Regulations

  • The Secretary of Education is specifically empowered to issue necessary rules and regulations.

  • Violators of the Act or its implementing rules face penalties:
    • A fine not exceeding five thousand pesos;
    • Imprisonment for up to five years;

  • If the violation is committed by a manager, director, representative, agent, or employee on behalf of a natural or juridical person:
    • The natural or juridical person is also liable to penalties corresponding to the offense.
    • The individual offender may also face personal or pecuniary penalties, or both.
  • When the principal or employer is a juridical person, it is liable only to the pecuniary penalty corresponding to the offense.

Effective Date

  • The law took effect immediately upon its approval on June 12, 1948.
