Authority to Issue Implementing Rules and Regulations
- The Secretary of Education is specifically empowered to issue necessary rules and regulations.
- These rules and regulations serve to implement and enforce the provisions of the Act effectively.
Penalties for Violation
- Violators of the Act or its implementing rules face penalties:
- A fine not exceeding five thousand pesos;
- Imprisonment for up to five years;
- Or both fines and imprisonment, at the discretion of the court.
- If the violation is committed by a manager, director, representative, agent, or employee on behalf of a natural or juridical person:
- The natural or juridical person is also liable to penalties corresponding to the offense.
- The individual offender may also face personal or pecuniary penalties, or both.
- When the principal or employer is a juridical person, it is liable only to the pecuniary penalty corresponding to the offense.
Effective Date
- The law took effect immediately upon its approval on June 12, 1948.
