Defined fishing gear: “sudsud”
- Section 1 defines “Sudsud” (scissor or puh net) as a fishing gear with nettings mounted on two (2) collapsible bamboo or wooden poles.
- Section 1 states that the gear is fitted with or without a wooden flat shoelike device.
- Section 1 provides that “sudsud” is operated on a motorized fishing boat.
Geographic coverage: Panguil Bay
- Section 2 prohibits operation of “sudsud” in Panguil Bay.
- The prohibition covers fishing done for catching fish and/or other fishery aquatic products in Panguil Bay.
Prohibited persons and activities
- Section 2 makes it unlawful for any person to operate “sudsud” in Panguil Bay.
- Section 2 makes it unlawful for any corporation, association, partnership, or cooperative to operate “sudsud” in Panguil Bay.
- Section 2 prohibits operating “sudsud” specifically for catching fish and/or other fishery aquatic products in Panguil Bay.
Penalties and administrative enforcement
- Section 3 imposes criminal liability for any violation of the Order.
- Section 3 provides a fine of Five Hundred Pesos (P5,00.00) to Five Thousand Pesos (P5,000.00) for the offender.
- Section 3 also authorizes imprisonment in the discretion of the Court.
- Section 3 empowers the Director of Fisheries and Aquatic Resources to impose an administrative fine not more than Five Thousand Pesos (P5,000.00).
- Section 3 further empowers the Director to cancel the commercial fishing boat license, or to impose both the administrative fine and cancellation of the license at his discretion.
Repeal of inconsistent rules
- Section 4 provides that all existing administrative orders, rules and regulations, and parts thereof that are inconsistent with the Order are modified or repealed accordingly.
