Law Summary

Grounds for Filing Complaints

  • Complaints may be filed for various violations including:
    • Issuance of training certificates without proper training or assessment.
    • Conducting training without authority or with expired accreditation.
    • Training despite a cease and desist order.
    • Misrepresentation in accreditation applications.
    • Ignoring prescribed training standards.
    • Employing unqualified training personnel.
    • Enrolling trainees who do not meet course entry requirements.
    • Violating maximum trainee capacity in classrooms.
    • Failing to maintain training facilities and equipment.
    • Non-observance of quality system policies.
    • Failure to comply with MTC responsibilities and orders.

Filing of Complaints

  • Any person or entity with knowledge of violations may file a written, sworn complaint.
  • The complaint must include the identities of complainant and respondent, nature, grounds, timing, location of complaint, and sought relief.
  • Supporting documents must be attached when available.

Investigation Procedure

  • Complaints are docketed and investigated by a committee appointed by the MTC Executive Director.
  • Respondents receive a Show Cause Order and must file a verified answer within 10 calendar days, which may be extended once for another 10 days.
  • Failure to answer results in waiver and ex-parte proceedings.
  • The committee may issue subpoenas and conduct ocular inspections or call expert witnesses.
  • The proceedings are non-litigious but must observe due process.

Suspension of Accreditation

  • Pending investigation, the MTC may suspend course accreditation for up to the maximum penalty period if reasonable grounds suggest further violations or prejudice to national interest.
  • Suspension may be lifted by the Executive Director as warranted.

Resolution and Appeals

  • The Investigating Committee recommends findings within 10 days after submission.
  • The Executive Director issues final and executory decisions unless reviewed within 10 days.
  • Petitions for review are filed to the MTC Chairman within 10 days of decision receipt.
  • Filing a petition does not stay enforcement unless ordered by the Chairman.
  • The Chairman's decision on review is final and unappealable.

Table of Penalties

  • Penalties escalate with repeated offenses and include:
    1. Revocation of accreditation and blacklisting for issuing certificates without proper training.
    2. Suspension or revocation for training without valid accreditation or post-cease and desist order training.
    3. Revocation, denial of application, and expense charges for misrepresentation in accreditation.
    4. Warning, suspension, or revocation for disregarding training standards, employing unqualified personnel, improper trainee enrollment, or violating classroom and facility requirements.
    5. Suspension or revocation for inadequate training equipment affecting training quality.
    6. Warnings and suspensions for non-compliance with quality system policies and responsibilities.
    7. Sanctions for failure to comply with MTC orders, including suspension until compliance.

Important Legal Concepts

  • Compliance with the 1978 STCW Convention as amended is foundational.
  • The MTC acts as both regulatory and investigative body for maritime training center standards.
  • Due process is observed but procedures are administrative and less formal than court proceedings.
  • Suspension and revocation are key enforcement tools to ensure training quality and national maritime interest.
  • Any withdrawal by complainant does not restrict MTC's authority to proceed with investigations.

This framework ensures robust monitoring, enforcement, and quality assurance of maritime training centers in the Philippines in compliance with international maritime training standards.
