Purpose

  • Establishes rules and regulations for police assistance in implementing final decisions/orders/resolutions from COMELEC, DILG, or local government bodies exercising disciplinary power

Scope of Application

  • Supplemental to Rule 21 of the PNP Operational Procedures
  • Police assistance requests only acted on if:
    • Based on order from COMELEC, DILG, or local government body exercising disciplinary power
    • Written request by Bailiff or concerned DILG officer
    • Request personally filed by authorized Bailiff or DILG officer
    • Presentation of original or duly authenticated copy of final decision/order/resolution
  • Police assistance to be rendered within 3 working days from receipt of directive, unless otherwise specified
  • Supervision of implementation by Director, DIPO
  • Formation of Special Task Groups for national/regional (DIPO), provincial (PRO), and municipal (PPO) level officials
  • Operational costs to be borne by agency issuing final decision/order/resolution
  • Discretion to deploy sufficient personnel considering case importance and local peace and order
  • Minimum leadership rank: Police Senior Inspector; all personnel in uniform
  • Emphasis on respect for individual rights and limited use of force
  • PNP role limited to peace and order, crowd control, and security of authorized officials; no participation in forcibly entering offices or physically removing officials
  • PNP personnel to maintain impartiality and neutrality
  • Final decision to implement lies with authorized COMELEC, DILG, or local government official

Procedures

  • Verify authenticity of final decision/order/resolution
  • Conduct discreet verification regarding the subject matter
  • Secure clearance from Chief, PNP before acting
  • Form Special Task Group led by responsible officer; submit member list to Director, DIPO
  • Conduct briefing for clear role assignments
  • Ensure availability of ambulance, fire truck, and Civil Disturbance Management contingent
  • Coordinate with territorial and authorized officials prior to operation
  • Use video coverage and encourage media presence for documentation
  • Arrested persons to be turned over to local precinct if outside the jurisdiction of the Special Task Group
  • Convene Crisis Committee if necessary
  • Consult higher commanders when in doubt
  • Submit after-activity report detailing personnel involved, place/time/duration, actions performed, and incidents
  • Forward report copies to COMELEC/DILG/Local Government Unit requesting assistance

Liability Clause

  • Violations subject to administrative investigation
  • Commanders included under command responsibility principle
  • Criminal complaints filed if warranted under Revised Penal Code or other statutes

Repealing Clause

  • Previous inconsistent issuances, memoranda, rules, and regulations by the PNP are repealed or amended accordingly

Effectivity

  • SOP takes effect 15 days after filing a copy at the University of the Philippines Law Center
  • Complies with EO No. 292 (Revised Administrative Code of 1987) Sections 3 and 4, Chapter 2, Book VII
