Restrictions on Withdrawal and Loan Provisions
- Funds in the special trust fund are not to be withdrawn except as mandated.
- Full fund generation required before withdrawal, except for an amount specified in Section 4.
- Rehabilitation Committee may secure a long-term loan (up to six million pesos) from GSIS or SSS pending full fund generation.
- Loan to bear interest not exceeding 3% per annum, secured solely by stamp sale proceeds.
- Sales proceeds first applied to amortization, with excess payments reducing interest costs.
Qualification for Benefits and Rehabilitation Committee Composition
- Only agricultural tenants or owners cultivating land at eruption time are eligible if their land was rendered useless, barren, or unfit.
- A Rehabilitation Committee is created with specified government officials and presidential appointees.
- Committee has exclusive control and management of the special trust fund.
- The Committee compiles the list of qualified beneficiaries within 60 days of the Act’s approval.
- The Committee ceases to function once funds are fully disbursed.
Use of Funds: Land and Housing Allocation
- Funds used to purchase agricultural land, preferably in Batangas, distributed in five-hectare lots per family.
- Construction of houses for beneficiaries capped at one thousand pesos each.
- Prioritizes land distribution to those unable to find other livelihoods.
- Larger families receive priority if funds are insufficient.
- Surplus land reverts to public domain, disposed of per Public Land Act with priority to Taal Lake area inhabitants.
- Remaining funds used for agricultural inputs and infrastructure like access roads.
Powers and Operational Rules of the Rehabilitation Committee
- Authority to issue implementing rules and regulations in accordance with the Act.
- Power to create necessary forms, issue subpoenas, and access public records.
- May utilize government employees without additional compensation for clerical support.
- Required to maintain books of accounts subject to government auditing.
- Provincial Auditor of Batangas serves as ex officio auditor.
Options upon Land Rehabilitation and Forfeiture Provisions
- If land becomes arable again and the area declared safe, original landowners may revert to original lands.
- If original land is reclaimed, forfeiture of grant land (five hectares) and improvements in favor of government is required.
- Alternatively, beneficiaries may keep granted lands, forfeiting equivalent area from original land.
- Forfeited lands revert to public domain under Public Land Act.
- Applications processed by Bureau of Lands if Rehabilitation Committee no longer exists.
Appropriations for Printing Costs
- Initial appropriation of thirty thousand pesos for printing costs reimbursed from the special trust fund.
- Subsequent printing costs to be paid from the special fund.
Effectivity
- Act takes effect immediately upon approval without Executive approval on June 18, 1966.
