Roles and Responsibilities in Plan Formulation
- City or Municipal Development Council (CDC/MDC) leads plan formulation/updates with community consultation.
- Technical support is provided by city/municipal planning and development coordinators and agriculturists.
- Provincial Development Council (PDC) performs similar functions at the provincial level with support from provincial planning coordinators and agriculturists.
- Plans of component cities/municipalities must align with the provincial comprehensive land use plan.
Devolution of Plan Review and Approval Powers
- HLRB’s power to review and approve city and municipal land use plans is devolved to provincial sanggunian panlalawigan.
- Provincial Board Land Use Committee (PLUC) assists in plan reviews ensuring consistency with provincial plans, national policies, and urban development laws.
- PLUC composition includes provincial planning officials, representatives from NGOs, and relevant national agencies.
- Regional Land Use Committees (RLUC) review provincial and highly urbanized/independent city plans for consistency with regional physical plans.
- HLRB retains review authority for provinces, highly urbanized cities, and municipalities in Metropolitan Manila.
- Plan review must be completed within three months or plans become deemed valid.
Implementation of Land Use Plans and Locational Clearances
- Authority to issue locational clearances for locally-significant projects is devolved to cities and municipalities with approved plans.
- HLRB retains clearance authority over nationally or regionally significant projects.
- Cities and municipalities assume enforcement responsibilities and may seek assistance from HLRB and other agencies.
- Fees collected for locational clearances now accrue to the local government issuing them.
- HLRB to establish an information system to monitor land use changes and plan implementation.
Technical Assistance and Support
- HLRB must provide technical and other assistance to cities and municipalities to ensure plan compliance with national standards.
- NEDA and other concerned national government agencies shall assist provinces similarly.
- Assistance to LGUs is to be provided free of charge.
Transitional Provisions for Existing Land Use Plans
- Cities and municipalities with plans approved since January 1, 1989, retain clearance issuance powers.
- Such LGUs must update their land use plans within five years from approval.
Effectivity
- The Executive Order takes effect immediately upon issuance.
