Background and Previous Legal Framework
- Executive Order No. 525 (1979) initially designated the Public Estates Authority (PEA), now the PRA, as the primary agency responsible for reclamation projects.
- EO No. 525 required presidential approval of all reclamation projects upon recommendation by the PEA/PRA.
- Reclamation projects were to be undertaken by PEA/PRA or through contracts they executed.
- National government agencies authorized under their charters could undertake reclamation in consultation with the PEA/PRA and with presidential approval.
Legal Basis for Delegation
- Paragraph 2, Section 31, Chapter 10, Title III, Book III of the 1987 Administrative Code empowers the President to transfer functions under the Office of the President to any department or agency.
- The delegation under this EO uses this legal basis to promote simplicity, economy, and efficiency in government operations.
Preservation of Presidential Authority
- The EO expressly states that the delegation does not diminish the President's authority.
- The President retains the power to modify, amend, or nullify any actions taken by the PRA in relation to reclamation projects.
Repeal and Amendment of Inconsistent Issuances
- Any previous executive issuances that conflict with this EO are repealed or amended as necessary.
Immediate Effectivity
- The EO took effect immediately upon issuance on June 24, 2006.
