Law Summary

Commencement of Office Terms

  • Terms of officials elected under this Act begin at noon on June 30 following election.
  • For officials elected in December 5, 2022, and thereafter, terms commence at noon on January 1 following election.

Hold-Over Provision

  • Incumbent barangay and sangguniang kabataan officials remain in office until their successors are duly elected and qualified.
  • Officials may still be removed or suspended for cause.
  • Officials who are ex officio members of local sanggunian continue to serve in those roles until the next election.

Funding for Implementation

  • Necessary funds to implement the Act to come from the appropriations of the Commission on Elections (COMELEC) under the General Appropriations Act or supplementary appropriations.

Repealing Clause

  • Any laws, acts, executive orders, or regulations inconsistent with this Act are repealed, amended, or modified accordingly.

Separability Clause

  • If any part of the Act is declared unconstitutional, the remainder continues to be in effect.

Effectivity

  • The Act takes effect immediately after publication in the Official Gazette or two newspapers of general circulation.
