Authority and governing charter linkage
- Section 7 provides that Republic Act No. 8292, otherwise known as the Higher Education Modernization Act of 1997, forms part of this Act and together serves as the governing charter of the Academy.
- Section 8 provides that all powers, functions, privileges, responsibilities, and limitations to the Academy and its officials under existing laws are deemed granted to, or imposed upon, the Academy and its officials whenever appropriate.
Establishment of PMMA campus
- Section 2 establishes a campus of the Philippine Merchant Marine Academy (PMMA) in Cagayan de Oro City, Province of Misamis Oriental, to be known as the PMMA-Cagayan de Oro City Campus.
- Section 3 provides that the campus shall primarily offer short-term, technical-vocational, undergraduate, and graduate courses within its areas of competency and specialization, pursuant to PMMA’s mandate.
- Section 3 provides that the campus shall offer programs according to its capabilities as the Board of Regents may deem necessary for accomplishing the objectives of the campus and meeting human resource development needs of Cagayan de Oro City, the Province of Misamis Oriental, and Region X.
- Section 3 mandates that the campus undertake research and extension services, and provide progressive leadership in these areas.
Campus leadership and staffing
- Section 4 provides that the campus shall be headed by a Campus Administrator who shall render full-time service.
- Section 4 provides that the Campus Administrator shall be appointed or designated by the Board, upon the recommendation of a search committee and the President, subject to guidelines, qualifications, and standards set by the Board.
Minimum operating requirements
- Section 5 requires the campus to ensure that minimum requirements for the operation of the Cagayan de Oro City Campus, including those related to its course offerings, are fully complied with.
Transfer of assets, personnel, records, and liabilities
- Section 6 provides that all assets (real and personal), personnel, and records of the PMMA-Cagayan de Oro City Campus are transferred to the Academy.
- Section 6 provides that the transfer includes the campus’s liabilities or obligations to the Academy.
- Section 6 provides that the positions, rights and security of tenure of faculty members and personnel employed at the campus under existing laws prior to integration to the Academy shall be respected.
Land ownership and reversion
- Section 6 declares that parcels of land belonging to the government occupied by the campus are the property of the Academy and shall be titled under the Academy’s name.
- Section 6 provides that if the Academy ceases to exist or is abolished, or if the parcels of land are no longer needed by the Academy, the same shall revert to the local government units concerned or to the Republic of the Philippines, as the case may be.
Funding, severability, and repeal
- Section 9 requires that the amount necessary to carry out the provisions of the Act shall be included in the General Appropriations Act.
- Section 10 provides that if any part or provision is declared invalid or unconstitutional, the remaining parts or provisions not affected shall remain in full force and effect.
- Section 11 provides that all other laws, presidential decrees, executive orders, rules and regulations contrary to or inconsistent with the Act are repealed or modified accordingly.
