A presidential decree is enacted to address the issue of unlawful entry into military bases in the Philippines, imposing punishments for re-entry without permission from the base commander or his representatives.

Definition of Military Base

  • Covers all military, air, naval, and coast guard reservations, bases, forts, camps, arsenals, yards, stations, or installations within the Philippines.

Prohibition and Penalization of Unauthorized Re-entry

  • Prohibits any person from re-entering or being found inside any military base without the express or implied permission of the base commander or authorized representative after being previously removed and ordered not to return.
  • Establishes escalating penalties for repeated offenses:
    • First offense: Imprisonment up to 10 days, or fine up to ₱100, or both.
    • Second offense: Imprisonment from 10 days to 1 month, or fine from ₱100 to ₱200, or both.
    • Third and subsequent offenses: Imprisonment from 1 to 6 months, or fine from ₱200 to ₱1,000, or both.

Property Rights Within Military Bases

  • Ensures that persons owning private land within military bases are not denied their legal right of ingress and egress to and from their property.

Effectivity

  • The law takes effect 30 days after its publication in the Official Gazette or a newspaper of general circulation in the Philippines.
