Rationale and Objectives
- Indiscriminate mooring has caused considerable structural damage to bridges.
- Such damage might lead to loss of life and property.
- Repairs and reconstruction drain substantial government resources.
- The decree aims to ensure safety, longevity, and effective functionality of bridge structures by prohibiting mooring.
Penalties for Violation
- Owners or operators who violate the prohibition face imprisonment ranging from one to two years.
- Alternatively, they may be fined ₱10,000, or both penalties may be imposed at the court's discretion.
- They are also held financially liable for repair or reconstruction costs.
- In cases involving corporations or associations, the responsible top executives (President, General Manager, etc.) shall incur penalties.
- Foreign officers found guilty will additionally be deported without further proceedings.
Scope of Liability
- Liability includes both criminal punishments and financial restitution to the government.
- Applies to individuals, corporations, partnerships, and associations.
- Responsible officers/managers of corporations or entities are personally liable.
Repealing Clause
- Any existing laws, decrees, executive orders, rules, or regulations inconsistent or contrary to this decree are repealed or modified accordingly.
Effectivity
- The decree takes effect fifteen (15) days after its publication in the Official Gazette.
