Legal Basis for the Directive
- The LTFRB exercises its regulatory authority under Section 5 (b) and (k) of Executive Order No. 202.
- These provisions empower the Board to regulate public transportation and ensure the protection of commuters.
Recognition of Existing Insurance Policies
- All existing PPAI policies issued by PAMI and UNITRANS will remain valid and recognized until the coverage period specified in the policy lapses.
- This ensures that insured passengers do not lose coverage due to administrative or contractual technicalities.
Amendment and Supersession of Conflicting Issuances
- Any prior issuances, agreements, or parts thereof that are inconsistent with this Memorandum Circular are hereby modified, amended, or superseded.
- This maintains legal clarity and authority by establishing the current directive as prevailing.
Effectivity and Compliance Requirements
- The Memorandum Circular takes effect immediately upon its publication in a newspaper of general circulation.
- Compliance also requires the filing of three (3) copies of the circular with the University of the Philippines Law Center as mandated by Presidential Memorandum Circular No. 11, dated October 9, 1992.
- This procedure ensures transparency and official record-keeping.
