Sangguniang Panlungsod (City Council)
- Legislative body composed of Vice Mayor, ten regular members, barangay and youth federation presidents, and sectoral representatives.
- Powers to enact ordinances, impose penalties, protect environment, regulate businesses and land use, approve budget, grant franchises, and approve revenue measures.
- Has responsibilities including legal assistance to officials, promoting cooperatives, and ensuring delivery of basic services.
Legislative Procedures and Rules
- Adoption of internal rules including parliamentary procedures, disciplinary actions for members.
- Disclosure of financial and business interests required to avoid conflicts of interest.
- Weekly regular sessions, special sessions can be called by Mayor or majority.
- Quorum requires majority of members, with enforcement measures for absent members.
- Ordinances must be presented to Mayor for signing or may be vetoed with Sanggunian override by two-thirds vote.
- Review of ordinances by provincial Sanggunian Panlalawigan and barangay ordinances by Sanggunian Panlungsod with prescribed timelines.
- Ordinances take effect after ten days of posting and publication requirements.
Disqualification and Succession Rules for Elective Officials
- Disqualifications include convictions involving moral turpitude, administrative removals, dual citizenship, fugitive status, and certain incapacities.
- Permanent vacancies in mayor or vice mayor offices are filled by succession of the next ranking Sanggunian members.
- Vacancies in Sanggunian filled by appointment from same political party or recommended persons.
- Temporary mayoral vacancies result in vice mayor assuming duties, with limitations on appointment powers.
Qualifications, Powers, and Duties of Key Appointive City Officials
- Positions include Secretary of Sangguniang Panlungsod, City Treasurer and Assistant, City Assessor and Assistant, City Accountant, City Budget Officer, City Planning and Development Coordinator, City Engineer, City Health Officer, City Civil Registrar, City Administrator, City Legal Officer, City Social Welfare and Development Officer, City Veterinarian, City General Services Officer, City Environment and Natural Resources Officer, City Architect, City Information Officer, City Cooperatives Officer, City Population Officer, and City Agriculturist.
- All officials must be Filipino citizens, residents of the city, of good moral character, and meet specified professional qualifications and experience.
- Duties typically include formulation of policies and plans, implementation of programs, provision of technical assistance, supervision of office functions, legal and administrative support, and coordination with other agencies.
- Many officials have special roles during and after disasters, ensuring continuity and effectiveness of services.
City Fire Station, Jail, School Division and Prosecution Service
- Establishment of fire station led by fire marshal with firefighting responsibilities.
- Maintenance of secure city jail headed by warden, with focus on prisoner welfare and rehabilitation.
- Department of Education to create and maintain a city school division led by a superintendent.
- City prosecution service organized under Department of Justice headed by city prosecutor for criminal cases within the city.
Transitional and Final Provisions
- Existing municipal ordinances remain in force until replaced by Sanggunian ordinances.
- Corporate existence effective upon plebiscite ratification within 60 days from law approval.
- Current municipal officials and employees continue until new elected officials qualify.
- City succeeds to all assets, liabilities, and obligations of the former municipality.
- City remains under provincial jurisdiction and part of second congressional district until otherwise provided.
- No local tax rate increase for five years from city inception.
- Applicability of Local Government Code and complementary laws with provisions in this Act taking precedence if inconsistent.
