- "Member-operators in good standing": Members of TCs allowed to transact business despite internal disputes.
- "Intra-cooperative/leadership disputes": Conflicts within the management or leadership structure affecting cooperative functioning.
- "Certificate of Non-Resolution (CNR)": Official document issued by the Cooperative Development Authority (CDA) indicating unresolved disputes after a specified period.
Time Limit for Dispute Resolution
- TCs experiencing internal disputes are granted a six (6) month period to exhaust all remedies to settle issues.
- Within this period, members retain privileges under SBR No. 2003-06-01 to transact with the LTO and LTFRB.
Consequences of Non-Resolution
- Failure to resolve disputes within the six (6) month period results in cancellation of the TC's accreditation by the OTC Board.
- Cancellation of accreditation leads to the withdrawal of SBR No. 2003-06-01 privileges.
- The LTFRB is mandated to cancel the cooperative franchise(s) immediately following OTC accreditation cancellation.
Effectivity and Application
- For TCs with ongoing disputes at the time of the Resolution, the six-month period begins upon filing of the Resolution copies with the UP Law Center.
- For future disputes, the six-month period commences upon issuance of the Certificate of Non-Resolution by the CDA.
Administrative Directives
- This Resolution is to be circulated among all OTC-accredited primary TCs for their guidance and compliance.
- The Resolution reflects the consensus and approval of key officials including the OTC Chairman, LTFRB Chairperson, and representatives from various relevant government agencies.
