Legal Basis and Authority
- The order is issued pursuant to Section 68 of the Revised Administrative Code.
- The order increases the number of municipalities in Misamis Occidental by segregating barrios from the municipality of Tangub.
- The act of increasing municipalities is carried out in accordance with Act No. 3537 and Executive Order No. 220 (series of 1929).
- The order proceeds upon a petition of inhabitants of specified barrios and upon recommendation of the Provincial Board of Misamis Occidental.
- The order is acted upon through the Secretary of Finance and the Secretary of the Interior, together with the presidential action.
Petition, Recommendation, and Purpose
- The order is based on a petition by the inhabitants of the barrios of Bolinsong, Bagumbang, Buracan, Dimalco, Galolot, and Tiaman.
- The petition requests that those barrios be separated from the municipality of Tangub (Misamis Occidental).
- The petition further requests that the separated barrios be organized into a regular municipality named Bonifacio.
- The Provincial Board of Misamis Occidental issues a recommendation for the requested segregation and organization.
- The resulting purpose is the creation of a regular municipality with a designated seat of government and technical territorial boundaries.
Creation of Bonifacio Municipality
- The order creates the municipality of Bonifacio as a regular municipality.
- Bonifacio is organized through the segregation of the specified barrios from the municipality of Tangub.
- The seat of government of the municipality of Bonifacio is in the sitio of Digson.
- The order increases the municipalities of Misamis Occidental from ten to eleven by this segregation.
- The municipality of Bonifacio is formed with territory defined by a technical boundary description.
Bonifacio’s Territory and Boundaries
- The territory of Bonifacio is defined by a boundary that begins at point a1a and ends at the point of beginning.
- The boundary description uses reference points labeled a1a to a18a and links multiple cadastral and index map references.
- The boundary begins at a1a, identified as identical to M. B. M. No. 2 (equal to P. B. M. No. 2), Tangub cadastre, B. L. Cad. No. 271.
- The boundary proceeds through segments referencing mapped monuments such as M. B. M. Nos. 3 to 12, including directions and distances such as:
- 436.45 m (from a1a to a2a),
- 927.37 m (from a2a to a3a),
- 8,310.64 m (from a11a to a12a),
- 9,600.20 m (from a12a to a13aa),
- 179.95 m (from a13aa to a14a).
- The boundary incorporates water and shoreline courses, including references to Macaias creek, Dimalco creek, Bimaico creek, Bambang River, Bagumbang River, Pangil Bay, and Migpangi River.
- All points are shown on the boundary and index map of Tangub Cadastre B. L. Cad. No. 271, cases Nos. 3 and 4.
Adjusted Territory of Tangub
- The municipality of Tangub retains its present territory less the territory comprised in the municipality of Bonifacio.
- The order’s territorial effect is therefore a reduction of Tangub’s area by the portion transferred into Bonifacio.
Timing of Effectivity and Fiscal Condition
- The organization of the municipality of Bonifacio takes effect on January 2, 1940.
- The effectivity is subject to a condition requiring Bonifacio to assume the obligation of paying its proportionate share of the cost of the cadastral survey of the municipality of Tangub.
