Purpose and authorized creation

  • The President creates, in the Province of Cotabato, an independent municipality known as the Municipality of Makilala.
  • The created municipality consists of a defined portion of the former Municipality of Kidapawan separated by a specified boundary line.
  • The creation proceeds upon compliance with conditions related to leadership, qualification of officials, and financial capacity.

Territory, boundary, and separation

  • Makilala is formed from that portion of Kidapawan separated by a boundary line starting at M.B.M. No. 3 on the Kidapawan–Malang boundary line.
  • The boundary line follows the Saguing River upstream to its source somewhere on Mount Apo.
  • The boundary line then continues until it touches the Cotabato–Davao boundary line.
  • The Municipality of Kidapawan retains its present territory minus the portion included in Makilala.

Municipal component barrios

  • Makilala contains the following barrios: Lamitan, San Vicente, Santa Catalina, Malasila, Indangan, Bulacanon, Mala-ang, Libertad, Saguing, Luna, Bulatucan, Kisante, Garsica, and Junction.
  • Lamitan is designated as the seat of the municipal government of Makilala.

When Makilala begins to exist

  • Makilala begins to exist upon the appointment and qualification of the mayor, vice-mayor, and a majority of the councilors.
  • Makilala begins to exist upon certification by the Secretary of Finance that the municipality is financially capable of implementing the Minimum Wage Law.
  • The Secretary of Finance must also certify that Makilala can provide all statutory obligations and ordinary essential services of a regular municipality.
  • The Secretary of Finance must further certify that the mother municipality of Kidapawan, after segregation, can still:
    • Maintain its municipal government credibly;
    • Meet all contractual and statutory obligations;
    • Provide essential municipal services.
