Purpose and policy against falsification
- The LTFRB adopts rules for online verifiable and tamper-proof Certificate of Public Convenience (CPC) documents and franchise stickers.
- The circular implements a campaign against colorum vehicles and fixers.
- The LTFRB uses a government printing solution to deter counterfeiting, tampering, and falsification of CPCs, Certificate of Confirmation, and Franchise Stickers.
- The system is designed to enable detection of alterations or falsification of franchise documents.
Government printer and secure technology
- The LTFRB uses a Memorandum of Agreement (MOA) with the National Printing Office (NPO).
- The NPO provides a secure, stand-alone platform for online verification of CPC, Confirmation Certificates, and Franchise Stickers.
- The platform relies on patented technology and a nonreproducible identity token affixed to CPCs, Confirmation Certificates, and Franchise Stickers.
- The NPO provides proprietary software for LTFRB integration of encoding, scanning, and digital storage of franchise documents into existing workflows.
Online verifiable CPC issuance schedule
- A tamper-proof on-line verifiable Certificate of Public Convenience is issued by the LTFRB Central Office or Regional Office that issued the corresponding Decision.
- The circular sets a CPC issuance schedule tied to the year the current CPC expires.
- For CPCs and franchises expiring in 2014, the CPC is issued as the Decision is released.
- For CPCs and franchises expiring in 2015, the CPC is issued from July 1 to August 31, 2014.
- For CPCs and franchises expiring in 2016, the CPC is issued from September 1 to October 31, 2014.
- For CPCs and franchises expiring in 2017, the CPC is issued from November 1 to December 31, 2014.
- For CPCs and franchises expiring in 2018, the CPC is issued from January 1 to February 28, 2015.
- For CPCs and franchises expiring in 2019, the CPC is issued from March 1 to April 30, 2015.
Consequences for failure to secure CPC
- Failure of grantees to secure the tamper-proof diploma type CPC according to the schedule is a cause for not accepting any application or petition involving the affected franchise.
- Failure is also a cause for non-confirmation of the authorized units included in the affected franchise.
- If the contents of a duly issued On-line Verifiable CPC change due to a petition or application approved by the Board or the Regional Director, the grantee must surrender the CPC for annotation of the changes or revisions.
- The approved petition or application is not released unless the CPC is surrendered for annotation.
Confirmation certificate and franchise sticker rules
- The Confirmation Certificate and Franchise Sticker are issued by the LTFRB Central Office or the Regional Office concerned.
- Issuance requires submission of the Official Receipt for the yearly registration of the motor vehicle at the Land Transportation Office (LTO).
- For grantees of new CPCs and newly registered units in cases of:
- Dropping and Substitution,
- Sale and Transfer,
- Sale and Transfer with Dropping and Substitution, and
- Register in Lieu of Authorized Unit,
grantees must secure the Online Verifiable Confirmation Certificate and Franchise Sticker THIRTY (30) DAYS after registration with the LTO.
- The system requires a supporting submission for new issuance: grantees must submit the new OR and CR issued by the LTO.
Delays, fines, and timing
- Failure to secure the Online Verifiable Confirmation Certificate and Franchise Sticker within THIRTY (30) DAYS after LTO registration results in a fine.
- The fine is Php 1,000.00 per month of delay.
- Delay is counted from the lapse of the 30-day period.
- Any fraction of a month is counted as one (1) month.
Fees for CPC, confirmation, and stickers
- The cost for an On Line Verifiable CPC is PhP250.00 for first page and PhP100.00 for every succeeding page.
- The cost for an On Line Verifiable Confirmation Certificate and Franchise Sticker is PhP200.00/set.
- Grantees who already registered their PUV units in 2014 with plate numbers ending in 1, 2, 3, 4, 5 and 6 and paid Php75.00 for the original Confirmation Certificate and Franchise Sticker must secure their 2014 Online Verifiable Confirmation Certificate and Franchise Sticker starting July 1, 2014.
- Those grantees must pay an additional cost of Php125.00 per unit.
Effectivity and supersession
- The circular takes effect immediately following its publication in a newspaper of general circulation.
- It also takes effect upon filing of three (3) copies with the UP Law Center pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
- All other issuances or parts inconsistent with the circular are modified, amended, or superseded accordingly.
