Notice of Arrival and Departure

  • Shipping company or agents must send advance notice of vessel arrival and departure to the Commissioner of Immigration.
  • A similar notice must be sent to the immigration office having jurisdiction over the vessel's first or next port of call if different from the Port of Manila (POM) or Manila International Container Port (MICP).
  • Only one notice needed if the itinerary involves both POM and MICP, provided the second port is indicated.

Timing and Transmission of Notices

  • Notices must be sent at least 24 hours before arrival but not later than 12:00 noon of the day before arrival for vessels calling at POM or MICP.
  • For vessels whose first port call is outside POM or MICP, notices must be sent not later than 9:00 a.m. of the day before arrival at the outport.
  • For passenger vessels boarded abroad by Immigration Officers, requests must be submitted 30 days before estimated arrival; actual arrival notices must still comply with above deadlines.

Format and Filing of Shipping Notices

  • Notices are to be filed in duplicate with the Central Office Boarding Section in Manila and the respective Immigration District or Field Office.
  • Receiving clerks must record date, time of receipt, and affix their signature.
  • Consecutive control numbers are assigned annually for tracking (e.g., Control No. 001-95).
  • Shipping notices must be on legal size paper and follow a prescribed format (Annex A), which includes space for special remarks such as crew changes, repatriation, or conversion of vessel trade.
  • Corrections or amendments must be filed at least 3 hours before vessel arrival.

Escort of Alien Seamen

  • Written advice required to assign Immigration personnel escorts for alien seamen arriving at airports to join vessels or for repatriation departures.
  • Advice must be submitted at least 12 hours before scheduled arrival or departure.
  • Alien seamen may not leave immigration-controlled airport areas or disembark for shore leave unless escorted by assigned Immigration personnel.

Penalties for Late or Missing Notices

  • Late submission after prescribed cutoff times incurs an overtime processing fee of P1,000, credited to the Bureau's trust fund.
  • Entry without advance notice results in an administrative fine of P5,000 plus the P1,000 processing fee.
  • No passengers or crew allowed to go ashore, and no Immigration Port Clearance for departure granted until fines are paid or secured.
  • Commissioner of Immigration may waive fines if failure to give advance notice is due to distress, emergency repairs, bad weather/force majeure, medical emergency onboard, or cadaver unloading.

Repeal and Effectivity

  • Previous inconsistent orders, circulars, and issuances are revoked or amended accordingly.
  • The Order becomes effective 15 days after filing with the U.P. Law Center as per Administrative Code requirements.
