Authority of the Department of Public Works and Highways (DPWH)
- Under Section 3 of Republic Act No. 2000, DPWH is authorized to plan, designate, establish, regulate, vacate, alter, improve, maintain, and provide limited access facilities.
- Authority is exercised when traffic conditions, present or future, justify special facilities.
Designation of Expressway Sections as Limited Access Highways
- The Balintawak to Tabang section of the North Luzon Expressway is declared a limited access highway.
- The Nichols to Alabang section of the South Luzon Expressway is similarly declared.
- These designations are subject to rules and regulations imposed by DPWH through the Toll Regulatory Board (TRB).
Enforcement Measures and Coordination
- The National Capital Region (NCR) office of DPWH is ordered to close all illegal openings along the designated limited access highways.
- This action is to be done after consultation with the TRB and coordination with the Philippine National Police (PNP).
- NCR is instructed to organize an enforcement and security group to ensure the continued closure of right-of-way fences and implementation of DPWH/TRB rules.
Immediate Effectivity
- The Department Order takes effect immediately upon adoption.
- Signed and adopted on April 5, 1993, by the Acting Secretary of DPWH.
