Hourly basic rate formula
- Section 1 defines Hourly basic rate as the basic salary rate per hour.
- Section 1 computes hourly basic rate by dividing the basic monthly rate by 22 working days.
- Section 1 then divides the quotient by 8 hours to arrive at the basic salary rate per hour.
Differential must not reduce other benefits
- Section 1 provides that night shift differential pay under the Act is in addition to existing benefits and allowances.
- Section 1 prohibits any diminishment: night shift differential pay shall not in any way diminish benefits and allowances government employees presently enjoy.
Who is excluded from coverage
- Section 2 excludes government employees whose office hours fall between 6:00 in the morning to 6:00 in the evening; services beyond the regular 8-hour schedule are paid as overtime pay under existing laws, rules, and regulations.
- Section 2 excludes government employees whose services are required or on call, 24 hours a day.
- Section 2 lists uniformed personnel of the Armed Forces of the Philippines (AFP), Philippine National Police (PNP), Bureau of Jail Management and Penology (BJMP), Bureau of Fire Protection (BFP), and other similarly situated personnel.
- Section 2 requires that “other similarly situated” personnel be determined by the Civil Service Commission (CSC) in relation to coverage.
Rules for implementation by CSC and DBM
- Section 3 directs the CSC, in coordination with the DBM, to promulgate necessary rules and regulations for effective implementation.
- Section 3 makes the coordinated CSC–DBM rulemaking the mechanism for operationalizing the Act.
Funding responsibility and charging of appropriations
- Section 4(a) provides that for national government entities, the initial implementation amount shall be charged against existing appropriations of the concerned departments, bureaus, offices, and agencies.
- Section 4(a) provides that thereafter, necessary sums for continuous implementation shall be included in the annual General Appropriations Act.
- Section 4(b) provides that for local government units, the amount shall be charged against their respective funds, subject to Sections 325 and 331 of Republic Act No. 7160 (the Local Government Code of 1991).
- Section 4(c) provides that for government-owned or -controlled corporations and their subsidiaries, the amount shall be charged against their respective corporate funds.
Effectivity and publication requirement
- Section 7 provides that the Act takes effect 15 days after its publication in the Official Gazette or in at least two (2) newspapers of general circulation.
Separability and survival of remaining provisions
- Section 5 states that if any provision or part is held invalid or unconstitutional, the remainder of the law remains valid and subsisting.
Repeal and amendment rule
- Section 6 amends or modifies Section 18 of Republic Act No. 8305 accordingly.
- Section 6 repeals, modifies, or amends any law, presidential decree, issuance, executive order, letter of instruction, administrative order, rule, or regulation contrary to or inconsistent with the Act.
