Procedural Requirement for Case Number Assignment
- The old docket case number of the sold CPC or franchise must be replaced.
- A new docket case number is to be affixed to the newly issued CPC or franchise pursuant to the sale and transfer approval.
Problems in Previous Practice
- Current practice incorrectly reuses the same case number of the sold CPC or franchise even after cancellation.
- This reuse causes confusion and fosters potential fraudulent transactions, with multiple parties potentially claiming the same franchise.
- This practice undermines the integrity of the franchising system and creates administrative controversies.
Reference to Registrar of Deeds’ Practice on Torrens Title
- Upon sale, the previous Torrens title is canceled.
- A new Torrens title with a new title number is issued, referencing the original canceled title to maintain record continuity.
Board’s Decree on New Case Number Policy
- Hereafter, CPCs or franchises sold must be assigned a new and separate docket case number upon application for approval of sale and transfer.
- The old case number must be recorded in the first entry of the new docket for proper monitoring and reference.
Implementation and Compliance
- This directive is mandatory for the Central Office and all Regional Offices of the LTFRB.
- It applies to recording and reporting applications for approval of sale and transfer of franchises/CPCs.
Effectivity and Administrative Requirements
- The Memorandum Circular takes effect fifteen (15) days after publication in a newspaper of general circulation in the Philippines.
- Three copies of the Memorandum Circular are to be furnished to the UP Law Center pursuant to Presidential Memorandum Circular No. 11 (October 9, 1992).
