Expansion of Campuses and Educational Focus
- NSCA will maintain and strengthen original agricultural expertise of NOAC.
- Establishes five extension colleges located in Sipalay (Gil Montilla), Cauayan, Ilog (Barangay Bocana), Candoni (Barangay Gatuslao), and Hinoba-an (Barangay Pu-ok).
- The Kabankalan campus remains the main campus.
- Each extension campus focuses on specific programs tailored to local needs (e.g., mining, trade, agro-fishery, marine sciences, forestry).
Academic Programs Offered
- Offers undergraduate and graduate degree programs.
- Provides short-term technical or diploma courses.
- Offers technological vocational instruction and training in agricultural sciences and related fields.
Advanced Instruction and Mandate
- Provides advanced instruction and professional training in agriculture, science and technology, education, and other relevant fields.
- Promotes research, extension services, and leadership development.
- Retains primary mandate as an agricultural institution.
- Strengthens masteral and doctoral programs in agriculture.
- Transfers the existing high school to Department of Education, Culture and Sports supervision but allows operation on campus until current students graduate.
- May operate a laboratory school if it has a Department of Education.
Governance: Board of Trustees
- Governance vested in a Board of Trustees composed of:
- Chairman: Commission on Higher Education (CHED) Chairman
- Vice Chairman: President of the State College
- Chairpersons of Senate and House committees on education
- Regional Directors of National Economic and Development Authority (NEDA) and Department of Science and Technology (DOST)
- Presidents of the faculty, students, and alumni federations
- Two prominent citizens of Negros Occidental appointed for two-year terms
Board Policies and Relevant Laws
- Board to adopt and implement policies consistent with the Constitution, Republic Acts 7722 and 8292, and other tertiary education laws.
Specific Powers and Duties of the Board
- Enacts rules and regulations needed to fulfill NSCA’s mandate.
- Manages funds, including appropriations, donations, and income, exempt from taxes.
- Sets tuition and fees, adopting socialized schemes for accessibility.
- Authority to construct, repair, and procure equipment and property.
- Appoints administrative and academic officers upon recommendation.
- Fixes and adjusts salaries within applicable laws.
- Grants leaves and removes personnel for cause with due process.
- Approves curricula, admission, graduation policies, and disciplinary rules.
- Awards honorary degrees and non-degree certificates.
- Establishes branches, research and extension centers, chairs, scholarships, and fellowships.
- Delegates powers for operational efficiency.
- May undertake external management audits and reforms.
- Enters into joint ventures to maximize economic assets.
- Employs innovative education delivery methods to increase access.
- May extend the president’s term past retirement age under specific conditions.
Board Meetings
- Board convenes quarterly, with the Chairman entitled to call special meetings with proper notice.
- CHED Chairman or designated commissioner must be present.
- State College President serves as presiding officer in the absence of CHED Chairman.
Leadership and Administration
- The President of NSCA heads the institution, serving a four-year term, extendible once for four years.
- Appointment based on a Search Committee recommendation and under RA 8292.
- Vacancy filled by Officer-in-Charge; service over two years counts as a full term.
- Salary comparable to presidents of similar institutions.
- An Administrative Council assists in policy review and planning.
- An Academic Council composed of instructional staff supervises curricula, admissions, graduation, and disciplinary actions.
- Board appoints a secretary and the Treasurer of the Philippines serves as ex officio Treasurer of NSCA.
Non-Discrimination and Academic Freedom
- No religious affiliation or opinion inquiry in faculty appointment.
- Faculty prohibited from teaching for or against any religion.
- NSCA enjoys academic freedom.
Transition Provisions
- Current NOAC superintendent may serve as first NSCA president if qualified, with the prior term counted as first term.
- Transfer of all assets, liabilities, personnel, and records from NOAC to NSCA.
- Personnel’s position and tenure rights preserved.
- Loan or transfer of government apparatus, supplies, and personnel permitted to aid NSCA upon request.
Student Support and Equal Access
- Scholarship and affirmative action programs established for poor but deserving students.
- No admission denial based on sex, religion, cultural community, or ethnic origin.
Reporting and Integration
- Annual report on progress, condition, and needs to Congress within two months after classes start.
- May affiliate or integrate existing national schools whose programs align with NSCA objectives in coordination with CHED and DBM.
- Associated funds, properties, and obligations transferred to NSCA upon integration.
Funding and Auditing
- Initial funding added to previous NOAC appropriations; thereafter budget included in General Appropriations Act.
- Within 120 days after approval, NSCA must submit a five-year development plan, undergo management audit, establish organizational and academic structures, and set up four degree-granting units including graduate and arts and sciences units.
Faculty Appointment and Governance
- Faculty exempt from civil service exams but may be subject to other professional requirements.
- RA 8292 (Higher Education Modernization Act) integrated as governing part of NSCA’s rules.
General Provisions
- Other powers and responsibilities per laws applicable to state colleges are deemed granted to NSCA.
- Inconsistent laws, rules, and regulations are repealed or modified accordingly.
- The Act takes effect upon approval.
