Functions as national intelligence focal point
- Section 2 makes NICA the focal point for the direction, coordination, and integration of government activities involving national intelligence.
- Section 2 requires NICA to separate intelligence estimates of local and foreign situations.
- Section 2 directs that such separate intelligence estimates support the formulation of national policies by the President.
Leadership and succession of authority
- Section 3 establishes that NICA is headed by a Director-General assisted by a Deputy Director-General.
- Section 3 provides that both officials are appointed by the President and hold office at the pleasure of the President.
- Section 4 requires the Deputy Director-General to assist the Director-General in performing functions.
- Section 4 states that in the absence of the Director-General, the Deputy Director-General performs the functions of the Director-General.
Supervision and reporting lines
- Section 5 places NICA under the administrative supervision of the National Security Council and requires NICA to provide support services.

National Intelligence Board as advisory body
- Section 6 provides that the National Intelligence Board (NIB) continues to serve as the advisory body to the Director-General of NICA.

- Section 7 allows the National Security Director to sit in all meetings of the Board.
Internal structure and required offices
- Section 8 directs that NICA’s organization shall consist of the listed components.
- Section 8(a) creates the Office of the Director-General, which provides overall management and operation, executive staff support, public relations, legal service, and internal audit.
- Section 8(b) establishes the Directorate for Operations, headed by the Assistant Director-General for Operations, responsible for collection of information.
- Section 8(c) establishes the Directorate for Production, headed by the Assistant Director-General for Production, responsible for preparation of intelligence estimates and other reports and maintenance of automated data processing.
- Section 8(d) establishes the Directorate for Administration, headed by the Assistant Director-General for Administration, responsible for personnel and training, transportation and communications, supplies and materials, grounds and buildings maintenance, security, and other support services.
- Section 8(e) establishes the Management and Planning Office to formulate plans, policies, and programs on the direction, integration, and coordination of national intelligence activities and on operation and management improvement of the Agency.
- Section 8(f) creates the Office of the Comptroller, responsible for financial management and control for the Agency.
- Section 8(g) authorizes as many Field Stations as may be determined by the Director-General to undertake intelligence collection activities and provide reports necessary for assessments and estimates.
Organization and staffing approval
- Section 9 requires that NICA’s organization and staffing pattern be recommended by the Director-General.
- Section 9 requires that the recommended organization and staffing pattern receive approval of the President.
Transfer of assets, records, equipment, and personnel
- Section 10 provides that all funds, records, equipment, buildings, facilities, and other properties of NISA and CISA are transferred to appropriate NICA offices and divisions.
- Section 10 provides that personnel necessary for NICA operations are transferred based on qualifications and merit, as determined by the Director-General of NICA.
- Section 10 requires that after transfers, sums necessary to carry out the Executive Order are included annually in the General Appropriations Act.
Financial treatment and separation benefits
- Section 11 grants retirement benefits under existing laws, rules, and regulations to personnel whose services are terminated due to abolition or reorganization of NISA and CISA.
- Section 11 provides an alternative payment where retirement benefits do not apply: personnel receive the equivalent of one-month basic salary for every year of service or the equivalent nearest fraction thereof favorable to them.
- Section 11 imposes an upper limit: such payment shall not exceed the equivalent of twelve (12) months salary.
- Section 11 requires computation on the basis of the highest salary received.
Repeal, separability, and effectivity
- Section 12 repeals or modifies any laws, presidential decrees, executive orders, letters of instructions, and edicts inconsistent with Executive Order No. 246.
- Section 13 provides separability: invalidity or unconstitutionality of any provision does not affect other provisions that continue in full force and effect.
- Section 14 states that Executive Order No. 246 takes effect immediately.
