Corazon C. Aquino establishes the National Intelligence Coordinating Agency (NICA) under the Office of the President to streamline and integrate national intelligence efforts, replacing the abolished National Intelligence and Security Authority and Civil Intelligence and Security Agency.

Functions and Scope of NICA

  • Acts as the focal point for directing, coordinating, and integrating all government activities involving national intelligence.
  • Separates intelligence estimates related to local and foreign situations for policy formulation by the President.

Leadership Structure

  • Headed by a Director-General appointed by the President, serving at the President's pleasure.
  • Assisted by a Deputy Director-General, also appointed by the President.
  • The Deputy Director-General assists and acts in the absence of the Director-General.

Administrative Supervision and Reporting

  • NICA is under the administrative supervision of the National Security Council (NSC).
  • Provides support services to the NSC.
  • Can report directly to the President as required.

Advisory Body: The National Intelligence Board (NIB)

  • Serves as the advisory body to NICA’s Director-General.
  • Coordinates and integrates intelligence activities within the government.
  • Members appointed by the President.
  • The National Security Director may attend all Board meetings.

Organizational Structure of NICA

  • Office of the Director-General: Overall management, executive support, public relations, legal services, and internal audit.
  • Directorate for Operations: Responsible for intelligence information collection.
  • Directorate for Production: Handles preparation of intelligence estimates and reports, and manages automated data processing.
  • Directorate for Administration: Manages personnel, training, transportation, communications, supplies, facilities, security, and other support functions.
  • Management and Planning Office: Formulates plans, policies, and programs for national intelligence activities and agency improvements.
  • Office of the Comptroller: Oversees financial management and control.
  • Field Stations: Conduct intelligence collection and reporting, as determined by the Director-General.

Organizational Authority and Staffing

  • The Director-General recommends the organization and staffing pattern.
  • The President approves the structure.

Transfer of Assets and Personnel

  • Funds, records, equipment, properties, and personnel from abolished agencies (NISA and CISA) are transferred to NICA based on qualifications and merit.
  • Future funding for NICA included in the General Appropriations Act annually.

Retirement and Separation Benefits

  • Personnel terminated due to abolition or reorganization receive retirement benefits as per existing laws.
  • If ineligible for retirement, they receive separation pay equivalent to one-month basic salary per year of service, capped at 12 months’ salary.

Repeal and Modification of Inconsistent Laws

  • All existing laws, decrees, executive orders, and similar issuances inconsistent with this Executive Order are repealed or modified.

Severability Clause

  • If any part of the Executive Order is declared invalid or unconstitutional, other provisions remain effective.

Effectivity

  • The Executive Order takes effect immediately upon issuance.
