Disposition for Local Government, Community Facilities, and Institutions

  • Certain portions reserved for local government/community facilities, socioeconomic, charitable, educational, and religious institutions.
  • Eligibility limited to those already operating with existing facilities or occupying the land.
  • Allocation based on existing site allocations or actual land usage at the time of the Act’s effectivity.

National Government Center Administration Committee

  • Creation of a committee to administer, formulate policies, and implement land disposition.
  • Membership: Chairperson of Housing and Urban Development Coordinating Council (Chair), Chairperson of Presidential Commission for the Urban Poor, Quezon City Mayor, National Housing Authority General Manager, Secretary of Public Works and Highways, and two representatives from recognized people’s organizations (one each from NGC East and West sides).

Precedence of Proclamations and Contractual Obligations

  • Validity of obligations and vested rights arising from contracts under previous proclamations (1979, 1987, 1993, 1998) maintained if consistent with this Act.
  • Conveyance contracts after this Act’s approval to be executed by HUDCC or NHA.
  • Transfer of trusteeship functions of Home Guaranty Corporation over NGC Housing Project (West side) to NHA, excluding property where proprietary interest is held.

Tax Exemption

  • Exemption from Capital Gains Tax for lands already sold and/or disposed before or after this Act’s effectivity pursuant to government housing programs.

Congressional Oversight Committee

  • Creation of a committee composed of three Senators and three Representatives.
  • Appointed by the Senate President and Speaker of the House of Representatives.
  • Co-chaired by chairpersons of Senate and House committees on natural resources.
  • Tasked to monitor land disposition under this Act.

Implementing Rules and Regulations

  • National Government Center Administration Committee to promulgate rules within 30 days from effectivity.

Appropriations

  • Necessary funds for implementation to be included in the annual budgets of concerned agencies.

Repealing Clause

  • All inconsistent laws, decrees, orders, proclamations, rules, regulations, and issuances are repealed or modified accordingly.

Separability Clause

  • If any provision is declared invalid or unconstitutional, remaining provisions remain effective.

Effectivity

  • The Act takes effect immediately upon approval.
