Statement of Policy

Definition of Terms

  • Athletes with disabilities: Persons with disabilities as defined by RA 7277, Filipino citizens, recognized by PSC and NPC PHIL, who represented the country internationally.
  • International sports competitions: Include major competitions like the Olympics, Asian Games, SEA Games; World-level championships with at least 45 countries; Asian-level competitions with at least 25 countries; qualifying competitions for World-level games with at least 10 countries. Competitions granting prize money excluded.
  • National athletes: Filipino citizens in the national training pool, recognized by POC and PSC including athletes with disabilities accredited by NPC PHIL.
  • National coaches: Filipino coaches of national athletes, members of the national coaches training pool, accredited by PSC and POC or NPC PHIL (for AWD), officially coaching in international competitions.

Benefits and Privileges for National Athletes and Coaches

  • Twenty percent discount on transportation, hotels, lodging, restaurants, recreation centers, medicine, and sports equipment.
  • Minimum twenty percent discount on admission fees to theaters, cinemas, concert halls, circuses, carnivals, and other similar venues.
  • Free medical and dental consultations in government hospitals nationwide.
  • Coverage under the National Health Insurance Program through PSC-sponsored program.
  • A comprehensive social security program to be formulated by SSS within 180 days.
  • Priority in government livelihood programs subject to implementing guidelines.
  • Priority in national housing programs and affordable housing loans with conditions by NHA or HDMF.
  • Use of living quarters and training centers maintained by PSC during preparation and training.
  • Tax deductions for private establishments granting these discounts, with rules to be issued by Secretary of Finance.

Scholarship Benefits for National Athletes

  • Athletes winning in regular major international competitions are entitled to full tuition scholarship in state colleges or universities.
  • Priority access to state scholarships and study grants from CHED and TESDA, subject to their regulations.
  • Private colleges/universities encouraged to adopt similar scholarship programs.

Retirement Benefits for National Athletes and Coaches

  • Lump sum retirement benefit equivalent to 25% of total cash incentives received during active sports career.
  • Lump sum released within 60 days from filing retirement papers certified by PSC.

Death Benefits

  • Lump sum of P30,000 for funeral expenses paid to primary beneficiaries (spouse, children).
  • Secondary beneficiaries (parents, siblings) entitled if no primary beneficiaries exist.
  • Does not prejudice other benefits from other sources.

Cash Incentives for Athletes

  • Cash incentives for medalists in individual and team events at international sports competitions.
  • Amounts vary per competition and medal type from P150,000 up to P10,000,000 for Gold medalists at Summer and Winter Olympics.
  • Team event incentives divided based on team size and individual event incentive percentages.
  • Demonstration and exhibition sports receive 25% of Olympic medalists incentives.
  • Incentives may be adjusted by PSC in consultation with PAGCOR every three years.

Cash Incentives for Coaches

  • Coaches directly training athletes who win international competitions at least six months before competition eligible.
  • Incentives equal to 50% of respective athletes' cash incentives.
  • Incentives divided among multiple coaches per athlete or team.

Availment of Benefits and Privileges

  • Benefits availed upon presentation of valid PSC identification card, renewable annually.
  • Benefits under Section 4 cannot be combined with similar benefits from other laws.

Penalties

  • Violations of Section 4 benefits (discounts) punished with fines and/or imprisonment:
    • First offense: Fine P50,000 to P100,000 or imprisonment 6 months to 2 years, or both.
    • Subsequent offenses: Fine P100,000 to P200,000 or imprisonment 2 to 6 years, or both.
  • National athletes/coaches abusing privileges face 6 months imprisonment or fines P5,000 to P50,000, or both.
  • Corporations held liable via responsible officers.
  • Foreign violators face deportation after serving sentence.
  • Non-compliance may lead to revocation of business permits and franchises upon complaint and hearing.

Funding

  • Funding for cash incentives and retirement benefits sourced from PAGCOR's net cash income, directly remitted to National Sports Development Fund (NSDF).
  • Additional funding sourced from 50% national government share of PAGCOR gaming revenue.
  • Not less than 60% of NSDF automatically set aside for training and preparation of national athletes.

Transitory Provision

  • Past winners who claimed benefits under repealed RA 9064 considered to have fully claimed incentives.
  • Athletes who did not claim under previous law must claim within 3 years from effectivity; otherwise, rights are waived.

Implementing Rules and Regulations (IRR)

  • The PSC, with consultation from various agencies including POC, NPC PHIL, DOH, DepED, CHED, TESDA, DOF, BIR, PAGCOR, PHILHEALTH, shall issue IRR within 60 days.
  • Failure to promulgate IRR does not delay implementation of the Act.

Monitoring and Reportorial Requirements

  • PSC to submit reports on benefits and incentives granted to DOF, DBM, PAGCOR, Senate and House committees every 3 years starting within 3 years of effectivity.

Repealing Clause

  • RA 9064 (National Athletes, Coaches and Trainers Benefits and Incentives Act of 2001) repealed.
  • Inconsistent laws, decrees, orders, rules and regulations amended or repealed accordingly.

Separability Clause

  • If any provision declared unconstitutional, other provisions remain effective and enforceable.

Effectivity Clause

  • The Act takes effect 15 days after publication in two newspapers of general circulation.
