President Joseph Ejercito Estrada issues Executive Order No. 133, modifying import duty rates to support the agriculture and fisheries sector's competitiveness, in accordance with Republic Act 8435, exempting these sectors from tariff and duties for the importation of inputs, machinery, and equipment.

Scope of Tariff Exemption

  • Applies to enterprises engaged in agriculture and fisheries certified by the Department of Agriculture.
  • Exemption from payment of tariffs and duties for five years from the effectivity of the Act.
  • Covers importation of all types of agricultural and fishery inputs, machinery, and equipment.
  • Imported assets must be exclusively used by the importing enterprise.

Legal Authority

  • Presidential power to modify tariff rates based on Sections 104 and 401 of the Tariff and Customs Code of 1978 (Presidential Decree No. 1464), as amended.
  • Modification possible upon recommendation of the National Economic and Development Authority (NEDA).

Duty-Free Import Regulations (Section 1)

  • Importation rules and regulations for articles listed in Annex "C" follow guidelines specified in Annex "A".

Zero Duty for Articles in Annex "B" (Section 2)

  • Articles classified under Section 104 and listed in Annex "B" receive zero percent (0%) duty until February 8, 2003.
  • Importation of these articles is exempt from rules in Annex "A" including the certificate of eligibility or accreditation requirement.

Zero Duty for Articles in Annex "C" with Conditions (Section 3)

  • Articles listed in Annex "C" also receive zero percent (0%) duty until February 8, 2003.
  • Importation requires a certificate of eligibility or accreditation from the Department of Agriculture.
  • Subject to rules and regulations outlined in Annex "A".

Periodic Review and Monitoring (Section 4)

  • Department of Agriculture, Department of Finance, and Board of Investments to conduct annual review of Annexes "A", "B", and "C".
  • Must consult private sector and other government institutions.
  • Findings to be reported and possible amendments recommended to the President.

Effective Date and Application (Section 5)

  • Rates of duty prescribed in this order apply upon effectivity.
  • Applies to articles entered and withdrawn from warehouses in the Philippines.

Repeal and Modification of Inconsistent Issuances (Section 6)

  • All conflicting Presidential issuances, administrative rules and regulations are revoked or amended accordingly.
  • Specifically revokes Joint Department Administrative Order No. 1, series of 1998.

Effectivity Clause (Section 7)

  • Executive Order takes effect thirty (30) days after complete publication in two newspapers of general circulation.

  • Annexes "A", "B", and "C" detail the affected articles, eligibility requirements, and specific rules.
  • Available for reference at the Tariff Commission and NEDA.
