Reduction of Tariff Rates on Motor Vehicle Components, Parts, and Accessories
- Import duties on motor vehicle components, parts, and/or accessories listed in the Order's Annex are reduced according to the schedule indicated in Column 4 of the Annex.
- These articles are classified under Section 104 of the TCCP.
Applicable Rates for Japanese Imports and Documentation Requirements
- The applicable duty rate for Japanese imports is the PJEPA tariff rate subject to the submission of a proper Certificate of Origin (CO) Form JP.
- The Tariff Commission may issue tariff classification rulings to confirm the applicable duty rates upon request, pursuant to Section 1313(a) of the TCCP.
Compliance with Rules of Origin
- The reduced tariff rates apply only to articles that comply with the Rules of Origin as defined in Chapter 3 of the PJEPA.
- Articles entered or withdrawn from warehouses in the Philippines will be subjected to the duties prescribed, contingent on compliance with origin rules.
Right of Recourse
- The Philippines reserves the right to invoke trade remedy measures under national law, the PJEPA, and other international agreements to address import surges.
- This provision acts as a safeguard against unfair trade practices despite tariff reductions.
Repealing Clause
- Any prior issuances, orders, rules, and regulations inconsistent with this Order are repealed, amended, or modified accordingly.
Separability Clause
- If any provision of this Order is declared invalid or unconstitutional, other provisions not affected shall remain valid and enforceable.
Effectivity
- This Executive Order takes effect immediately upon publication in a newspaper of general circulation.
