Background and Legal Basis
- ASEAN Economic Ministers agreed in 2002 to reduce CEPT rates on at least 80% of products by 2007.
- The Philippine NEDA Board approved granting CEPT rates of 0% on listed products in 2007.
- Section 402 of the Tariff and Customs Code authorizes the President, upon NEDA's recommendation, to adjust protective import duty rates and modify duty forms.
Specific Provisions on Duty Rates (Section 1)
- Articles listed in Annex "A" are subject to CEPT rates as classified under Section 104 of the Tariff and Customs Code.
- The CEPT rates specified in the Annex apply to imports from ASEAN Member States who grant reciprocal CEPT concessions.
Implementation and Conditions (Section 2)
- Effective immediately upon order's effectivity, articles in Annex "A" will be imposed the prescribed duty rates.
- Imports must comply with Rules of Origin as defined in the CEPT Scheme Agreement signed on January 28, 1992.
Repeal and Modification of Inconsistent Issuances (Section 3)
- All prior presidential issuances, administrative rules, or regulations that conflict with this Executive Order are repealed or modified accordingly.
Effectivity and Publication Requirement (Section 4)
- The Executive Order takes effect immediately after its full publication in two national newspapers of general circulation in the Philippines.
