Scope and Coverage of Affected Articles

  • Articles classified under Section 104 of the Tariff and Customs Code as listed in Annex aAa and Annex aBa.

  • Annex aBa lists articles subject to a phased-in tariff reduction schedule under CEPT-AFTA from 1997 onwards.

Implementation of Tariff Rates for ASEAN Member States

  • Tariff rates for products in Annex aAa shall follow the 1997-2003 ASEAN Common Effective Preferential Tariff schedule.
  • Concessions apply only to imports originating from ASEAN member states applying CEPT concessions to the same products.
  • Products in Annex aBa will be subject to the 1997 ASEAN rate; subsequent years’ rates require separate executive orders.

Automatic Adjustment Mechanism for Changes in MFN Rates

  • If the Most Favored Nation (MFN) rates change for articles listed in Annexes aAa and aBa to rates prescribed in their respective tariff schedules, the preferential ASEAN tariffs automatically adjust accordingly without need for separate orders.

Discontinuance of Margins of Preference (MOPs)

  • MOPs previously granted under ASEAN Preferential Trading Arrangements will no longer apply to any products listed in Annexes aAa and aBa.

Effective Date and Compliance Requirements

  • Rates take effect immediately upon the Executive Order’s effectivity date for all articles entered or withdrawn for consumption in the Philippines.
  • Importers must comply with Rules of Origin under the CEPT-AFTA Agreement signed on 28 January 1992 to qualify for preferential tariffs.

Repeal and Modification of Conflicting Issuances

  • All presidential issuances and administrative rules contrary or inconsistent with this Executive Order are repealed or modified accordingly.

Immediate Effectivity

  • The Executive Order takes effect immediately upon signing.
  • Signed by President Fidel V. Ramos on October 31, 1997, in Manila.
